Officers Daniel Hodges and Harry Dunn just turned Trump into a defendant again. They are suing to dissolve his $1.776 billion rioter payout slush fund, backed by a prosecutor who quit the DOJ in protest. The DOJ's attorney stood in federal court and told the judge there was "no national database being created" from the voter registration records his office was demanding from every state in the country. Judge Walker put that quote in a footnote. Then noted that an executive order directing DHS to compile a "State Citizenship List" from voter registration data was issued almost immediately after those reassurances were given at the hearing. That footnote is doing serious work. The DOJ is now 0-8 out of 31 lawsuits filed to obtain state voter rolls. Four of the eight judges who ruled against them were Trump appointees. The legal theory at issue - that the Civil Rights Act of 1960, passed specifically to fight racial discrimination in Jim Crow voting booths, gives the federal government the right to conduct line-by-line federal audits of every state's voter rolls - has not found a single judge willing to accept it, including the four Trump put on the bench. Thirty-one lawsuits. Zero wins. The record and the footnote are the whole story.

Ken Paxton has been indicted for securities fraud. Impeached by the Texas House with majority Republican support. His whistleblower staffers reported him to the FBI, he fired them, a judge found he violated the Whistleblower Act, and Texas paid those staffers $6.6 million. His wife filed for divorce on, quote, "biblical grounds" - which is the Baptist way of saying Ken was at it again. This year he also ordered Texas public schools to prove they are displaying the Ten Commandments in their classrooms. Trump endorsed him anyway. Over a 23-year incumbent senator who tried to rename a highway after Trump in a last-ditch attempt to secure the nod. It did not work. Cook Political Report has already moved Texas into a fully competitive race if Paxton wins Tuesday. A Presbyterian seminarian running on faith and economic populism could be the first Democrat elected to the Texas Senate since 1988. A Republican strategist in the Atlantic piece described the situation as "deep kimchi." He was being diplomatic.
