@Hokman_W @ProgressiveRug I appear to have commented foolishly on legal matters in which I have no knowledge - I thought I read in the judgement something like "I do not find that the defendent intended to injure, indeed that is not alleged against her". It is likely more intricate.

@Stu2Brown @ProgressiveRug The claimant didn’t plead there was an intention to injure. The judges comments implied the contrary. There may have been a tactical reason to to not claim there was an intention to injure.
