“Cockroaches.” “Parasites.” An impeachment campaign. A demand for public apology. And now, a full-blown constitutional storm around the Chief Justice of India. In just 48 hours, India’s judicial discourse has exploded after CJI Surya Kant’s controversial courtroom remarks triggered outrage across the legal community, activists, media circles, and social media platforms. Senior Advocate Prashant Bhushan has openly accused the CJI of showing “antipathy towards activists” and demanded a public apology, arguing that such remarks strike at the heart of free speech and constitutional criticism protected under Article 19(1)(a). At the same time, lawyer J Anant Dehadrai has come out strongly in defence of the CJI, saying the remarks were aimed at organized vilification campaigns against judges and were part of a legitimate institutional self-defence against attacks on judicial integrity. What makes this controversy bigger than an ordinary social media outrage is the constitutional question behind it: Can sharp judicial remarks become grounds for impeachment under Article 124(4)? Legally, impeachment of a sitting CJI requires an extraordinarily high constitutional threshold — “proved misbehaviour or incapacity” backed by massive parliamentary support. Historically, very few impeachment motions against judges have even reached advanced stages. Yet politically and institutionally, the pressure is already building. Bar associations are demanding accountability. #CJIApologise is trending online. Retired judges and legal commentators are divided. The debate is no longer just about one courtroom remark. It is now about the limits of judicial language, institutional dignity, criticism of the judiciary, contempt law, activist litigation, and the future relationship between courts and civil society in India. One side says the CJI crossed the line. The other says the judiciary is under coordinated attack and finally pushed back. CJI Surya Kant clarifies on his yesterday’s statement on youth, misquoted by a section of media - “I am pained to read how a section of the media has misquoted my oral observations made during the hearing of a frivolous case yesterday. What I had specifically criticised were those who have entered professions like the Bar (legal profession) with the aid of fake and bogus degrees. Similar persons have sneaked into the media, social media, and other noble professions as well, and hence, they are like parasites. It is totally baseless to suggest that I criticised the youth of our nation. Not only am I proud of our present and future human resource, but every youth of India inspires me. It is not an exaggeration to say that Indian youth have great regard and respect for me, and I, too see them as the pillars of a developed India.” (File photo)

Yesterday the Hon’ble CJI clarified that his comments about “cockroaches” were aimed at those with fake degrees. Therefore, considering how paramount transparency is, the degree of the PM too should readily be available for scrutiny by the public. Which begs the question: why has the judiciary blocked all attempts for the public to see a copy of PM Modi’s degree & educational qualifications as claimed in his election affidavits? Since the SC has orally observed that it might even order a CBI probe into fake law degrees, it should first order DU & Gujarat University to release PM Modi’s degree certificates.

I write ✍️ It is well documented that the words like cockroaches, parasites, vermin, termite have three distinct impacts:   ·      It frames the targeted group as exploitative and extractive persons, who attack a healthy body, extract illegitimately from it and weakens and infects the host body (nation/society).   ·      It implies the existence of a healthy 'host' that must be protected at all costs by removing the parasite.   ·      It positions the elimination of parasites as a therapy or a treatment. The violence against parasites is often considered as cure rather than crime. Exterminating parasites carries no guilt.   That’s why International law, developed in the context of holocaust,  Rawanda, Combodia, Bosnia, Darfur and other atrocities, is unambiguous on dehumanising language thewire.in/law/the-chief-…
