Why do you hate the Constitution?
The core offense is unprecedented. While the President is “Commander in Chief of the Army and Navy of the United States,” U.S. Const. art. II, § 2, cl. 1, with authority to wage war, only Congress has lawful authority to “declare War.” U.S. Const. art. I, § 8, cl. 11. And while some of that authority is delegated by statute, that delegation is not plenary:
The constitutional powers of the President as Commander-in-Chief to introduce United States Armed Forces into hostilities, or into situations where imminent involvement in hostilities is clearly indicated by the circumstances, are exercised only pursuant to (1) a declaration of war, (2) specific statutory authorization, or (3) a national emergency created by attack upon the United States, its territories or possessions, or its armed forces.
50 U.S.C. § 1541(c) (War Powers Act).
None of the statutory conditions are satisfied. As Iran did not present an imminent threat to the United States or its legitimate interests, the introduction of our Armed Forces into hostilities is a violation of both domestic and international law.[1]
“To initiate a war of aggression . . . is not only an international crime; it is the supreme international crime.” Int’l Military Tribunal, Judgment of 1 October 1946, 22 Tr. of the Major War Criminals Before the Int’l Military Tribunal 421 (1948). Paradoxically, under our law, it is not a war crime. See 18 U.S.C. § 2441(c). But unlawful conduct committed in the course of the war he set in motion is.
The bombing of the Shajarah Tayyebeh girls' elementary school on the first day of the war has been reported ad nauseam,[2] but that barely scratches the surface. You’re supposed to look before you bomb[3]—and schools and hospitals are generally off-limits. Trump’s forces reportedly struck 236 health facilities in the first three weeks alone.[4] While the list of sins is too long to recount here, Secretary of Defense Hegseth’s decisions to dismantle Pentagon programs dedicated to civilian harm mitigation and response[5] and to fire the top Judge Advocates General of the Army, Navy, and Air Force, with the stated goal of shifting from “tepid legality” to “maximum lethality,”[6] speak to mens rea.[7]
And then, there is the incident off the coast of Venezuela last year, where shipwrecked survivors of a strike on an alleged drug-smuggling boat were killed by our military on the alleged order of Secretary Hegseth.[8] The Department’s War Manual could not be more pellucid: “Persons who have been incapacitated by wounds, sickness, or shipwreck are in a helpless state, and it would be dishonorable and inhumane to make them the object of attack,” U.S. Dep't of Def., Law of War Manual § 5.9.4 at 247 (June 2015, updated July 2023), and “orders to fire upon the shipwrecked would be clearly illegal.”[9] Either it is a war crime, or an “extrajudicial killing, which is a murder under international law, under our domestic law. There is no authority to do this.”[10] Importantly, Secretary Hegseth made a stunning admission against interest: “I watched it live. We knew exactly who was in that boat. We knew exactly what they were doing and we knew exactly who they represented.”[11]
Ordinarily, prosecuting these apparent crimes would be the province of the authorities. But a year after Signalgate and half a year after the Venezuelan incident, no discernible effort has been made to address what has become an avalanche of official malfeasance. And no one expects that, under this Administration, they ever will. How far the rot climbs up the ladder is unclear. But that pales in comparison to the original sin.
Only a man lawfully entitled to serve as President may act as Commander in Chief of the armed forces. Donald Trump swore an oath to support the Constitution and was adjudged by a competent court to have engaged in insurrection. He has not been absolved by Congress. An oathbreaking adjudged insurrectionist, not absolved by Congress, is constitutionally barred from serving as President. U.S. Const. amend. XIV, § 3. By definition, he is legally ineligible to serve. There is a challenge to Mr. Trump’s illicit ascension to that high office, Smith v. Trump, No. 25-cv-03602 (D.D.C. 2025), made in a timely manner; as such, this question is justiciable.

The United States is a signatory to the U.N. Charter. Charter of the United Nations and Statute of the International Court of Justice, June 26, 1945, 59 Stat. 1031, T.S. No. 993. It is the “supreme Law of the Land,” U.S. Const. art. VI, cl. 2, and thereunder, it provides: “All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.” U.N. Charter art. 2, ¶ 4. The only exceptions to the blanket ban on the use of force are those actions expressly authorized by the Security Council, id., art. 42, or taken in self-defense. Id., art. 51.
