Why do sendist (and LAs) keep saying doesn’t all have to be in B and F as the reports are in K? Last time I checked K wasn’t legally enforceable and who reads all attachments in K anyway? #ehcp

I know section A, E and strengths aren’t part of the jurisdiction of sendist but youd think updating those based on changes to B and F would make sense and would be reasonable to do so. Or no let’s just wait months for next annual review instead #ehcp

Send tribunal from an order around contents “…The plan should highlight individual trees, not a forest and we encourage the parties to work towards a workable and much shorter document.” - document in question was 14 pages long. That’s for a child with complex needs 🤔 #ehcp

Here’s an idea, in order to “best provide for a child’s complex needs” why not continue to give them their legal rights, which protects the individualised provision the individual child’s needs require, as set out in their legally protected EHCP. Wild suggestion I know.

@Headteacherchat Curious to know how headteachers are viewing the SEND proposals? Specifically that responsibility will move from LA to schools to make decisions and provide provision. It seems like this will cause a lot more parent complaints and a lot of work for schools.

The right to appeal placement to a Tribunal came from the 96 Education Act again under a Conservative Government. And again the 2014 Act extended rights - under a Conservative Government. Now a Labour Government is rolling back legal rights by decades. Shame on you Labour

@SpcialNdsJungle I think the Tribunal is quiet-quitting already. For the second time this year my hearings (separate appeals for different children) have been cancelled the day before. Got this today, despite both parties responding in full and on time, as per the order.

@TashComps Absolutely, that’s my point. The effort & burden of a DD appeal vs outcome. White paper will undoubtedly lead to more DD and more litigation what is a very adversarial process hence the data doesn’t match the true experience (if that makes sense)

@nomorecutz Not many families have the energy left to lodge DD claims - doesn’t mean it doesn’t happen. Plus *if* the white paper does go thro that will likely make the numbers of DD cases shoot up.

@TashComps No but I think there needs to be an avalanche of claims registered. Show the government an accurate reflection of DD in schools, which 402 claims 24-25 is absolutely not a true reflection of lived experience.
