Black Coffee granted leave to appeal in divorce battle with Enhle Mbali
The protracted divorce battle between South African actress Enhle Mbali Mlotshwa and internationally acclaimed DJ Black Coffee is poised to enter a new chapter as the Supreme Court of Appeal (SCA) prepares to revisit key legal issues later this year.
After more than six years of legal wrangling, Black Coffee (born Nkosinathi Maphumulo) has secured leave to appeal parts of a pivotal October 2025 ruling by the Gauteng High Court, Johannesburg. That judgment had declared the couple’s May 2011 customary marriage valid and in community of property, and found that their civil marriage in January 2017 was void, a conclusion Black Coffee disputes.
At the heart of the appeal are two contested questions of law, whether a valid customary marriage ever existed, and whether the maintenance award in favour of Mlotshwa was correctly granted.
Black Coffee argues the trial judge erred in both respects, claiming there was no factual basis for the spousal maintenance order and that earlier evidence did not support consent to a customary marriage.
Mlotshwa, meanwhile, has opposed the appeal, asserting that the evidence demonstrated full compliance with customary law and that Black Coffee’s participation in familial rituals showed clear consent. She also maintains that her maintenance needs were properly established during the original proceedings.
Legal experts say the SCA’s forthcoming decision could have broader implications for how customary marriages are interpreted in South African law, especially where antenuptial contracts and civil marriages intersect.
The high-profile nature of this case involving two of the country’s most recognisable public figures underscores ongoing public interest in the outcome.
