Sony NEEDS to improve their refund policy if they're set on going all digital. As soon you hit download on a game, you can't request a refund anymore. Even if you haven't booted it up once. So if you buy a digital game and it's completely broken - too bad.

A key disagreement was Nintendo’s claim that a 2013 Pokémon fan game should not have been used as prior art because it allegedly infringed Pokémon’s copyright. The JPO was not convinced. It called Nintendo’s interpretation “a completely unreasonable misunderstanding,” adding that “The mere possibility that the reasons for rejection could be subject to such an unreasonable misunderstanding has no bearing on the assessment of inventive step.” The examiner also rejected Nintendo’s complaints about references to characters like Ash, Pikachu, and Poké Balls. The notice said that even if those names were replaced with descriptions like “an object in the form of a boy wearing a red cap” or “a spherical object with a red upper half and a white lower half,” “the logical structure of the grounds for refusal remains unchanged.
