@washingtonpost A move like this from Donald Trump would be about tightening control over voting access—basically tying ballots to federal citizenship lists. Supporters will call it election integrity, critics will call it a barrier dressed up as policy.

It's worth mentioning that the right of the people to keep and bear arms originated in the English Bill of Rights, passed in 1689. Which means we inherited it from the English system as part of our bundle of rights as citizens in English colonies. That's why the second amendment doesn't create it. It merely restricts the Federal Government from infringing the right we had established almost a century before.

If President Trump attends the Supreme Court's oral arguments tomorrow on his birthright citizenship executive order like he says he will, he would be the first sitting president on record to do so. Presidents have avoided attendance in part to honor the separation of powers.

Facts are hard things. I wish I was sitting in. I have long been of the opinion that the timing of the 14th amendment and its subject matter obviously limited its application to matters pertaining to the resolution of legal matter that arose as a result of the change of circumstances in the legal status of various classes of individuals. Which would make birthright citizenship a nullity. Further, as many have said before, and in several different ways, the Constitution is not a suicide pact. If birthright citizenship actually existed, some country, such as China, could send millions of pregnant women here to have their children. Then whisk them back to China. But, 18 years after they were born, each one of them would have the right to come back to vote. Imagine the chaos which would ensue if, say, a million votes, were strategically located around the country. The Republicans would never win the Presidency again and might have a hard time winning any Senate seats. That's a real threat under the current interpretation of the amendment. And that threat should make it clear that that interpretation is untenable. I'll make one further remark. If the entire 14th amendment is restricted to the circumstances existent during and just after the Civil War, then that would limit the extent of due process. Which is critical to carrying out President Trump's deportation agenda. If illegals and aliens are not due the full package of citizen's due process, it would make it a lot easier to get them out. Plus, it makes sense that they wouldn't have the full panoply of rights. Imagine an invading army crossed our border, and each invader claimed they were due due process to deport them. How long and how many resources would that take. The idea that all people on American soil have the exact same bundle of rights is, therefore, ridiculous. We have to be able to defend our borders, and prudence requires, for that job, that we limit the rights of those deserving of deportation to resist expelling them out of the country.
