There’s two shifts there - one societally (broader acceptance for gay persons), but one jurisprudentially (where we now focus on the plain text rather than atextual sources).

Justice Thomas is actually the most irrelevant Justice on the Court and has been throughout his tenure. His career is littered with extreme positions his colleagues ignore and which will never become law.

@tralaleroc @Vibutler_ They give comprehensive reasoning when the case comes on the merits docket, as they did in this exact case, but doing so earlier can create a lock-in effect

@TrueVAIndie @Vibutler_ I don't see how those examples do anything to help anyone's case. I'm not objecting to a court providing an injunction or granting a stay; I am objecting to them doing so without an explicit reasoning.

@Vibutler_ I'd ask why not? The court is disturbing (and I use this term here non-pejoratively) what would be the normal state of affairs (a policy that is presumably legal) by not allowing it to take effect, so I think it's not unreasonable to ask that it explains why it's taking that step

Today Justice Jackson wrote 35 pages in dissent to an 8 Justice majority on the First Amendment. The longest dissent ever is Justice Stevens in Citizen's United, clocking in at 90 pages. Will she break Justice Stevens' record for longest dissent in the Louisiana case?

@QuinHillyer Yes, when he gets locked on to a bad idea (foreign relations here) he's really bad. It's why I wouldn't want a Court of 9 Thomases. If I had to choose, perhaps 9 ACBs. I can only assume this is how the left feels about Bruener, except he wasn't (very) wrong there.

@scotus_wire Pretty confident Gorsuch will get Chiles, and would be surprised if Roberts didn’t take Callais (if it’s not Roberts, it’s Alito). Someone obviously will have 2 cases from October.

Here's some SCOTUS math: after today's rulings, 4 cases remain from the October sitting, two of which are major ones (conversion therapy and VRA/race-based redistricting).
Thomas, Alito, and Gorsuch are the only justices who have yet to author an opinion from this sitting...
