UPDATE :Key murder suspect Molly Katanga has told court that she sustained injuries after being attacked by her husband, businessman Henry Katanga, presenting scars as part of her defence.
Testifying before the High Court in Kampala, Katanga said her husband had been suffering from persistent headaches and stress, and had declined to take medication prescribed by their family doctor.
She further told court that after allegedly hitting her, he walked away stating he intended to take his own life, moments before she heard a loud bang.

"The existence of an earlier, unregistered Trade Mark with established goodwill can be a ground for refusal or cancellation of a later registration." Affirms the High Court of Uganda
The Court held that the Registrar wrongly confined the concept of a “well-known mark” to defensive registrations. The doctrine applies equally in invalidation and passing off actions.
“A trademark that is well-known outside Uganda can also be recognised and protected under the common law in Uganda, even though the trademark owner has not registered or used that trademark in Uganda... The well-known trademark standard is applied in opposition and invalidation proceedings to curtail parasitic behaviour.”
The appellant demonstrated goodwill and public recognition since 2006, satisfying WIPO well-known mark factors:
“The appellant established broad public awareness of its mark and extensive exposure in various media. There was widespread market recognition and product-based association with the relevant public.”

'An employee cannot escape the disciplinary process by tendering a resignation or a retirement ‘with immediate effect.’ There exists nothing like ‘resignation with immediate effect’, affirms the Court of Appeal.
The Court held that there is no concept of resignation with immediate effect when disciplinary proceedings are underway, unless the employer expressly waives the notice period. The Court emphasized that both parties must adhere to the contractual and statutory notice obligations, underscoring the mutual nature of employment relations and the need for procedural fairness even upon exit.

Point of Law-Banking Law
When a bank customer uses their account for illegal activities, the bank is not obliged to give notice before closing that account.
As Justice F.M.S. Egonda-Ntende (as he then was) observed — citing Encyclopaedia of Banking Law (Cresswell et al., Butterworths, para. 865), Paget’s Law of Banking (12th Ed., p.122), and Essays in African Banking Law and Practice (Grace Patrick Mukubwa et al., p.340):
“Where the customer is using the account for illegal transactions, the bank is under no obligation to give reasonable notice to such customer before the closure of his or her account. The bank’s duty not to aid illegality is superior.”
💡 Key takeaway
Banks have a higher duty to avoid facilitating illegal conduct than to maintain customer relationships.

The High Court of Uganda at Patongo has affirmed that customary land ownership requires proof of delivery, acceptance, and family knowledge; and clarifies that mere occupation, cultivation, or burials are insufficient; further holding that the doctrines of Gift Inter Vivos and adverse possession are mutually exclusive and cannot be simultaneously pleaded in a Plaint.
The Court observed that raising adverse possession in submissions was procedurally improper and amounted to an afterthought.
A cause of action must be pleaded and cannot be introduced casually at submissions.
