🚨 BREAKING NEWS: SEC + CFTC Crypto Guidance Signals End of the “Gensler Era” 🇺🇸 Galaxy Research’s Alex Thorn says the latest SEC and CFTC digital asset guidance marks a major shift in how the US regulates crypto. 📌 The new framework classifies digital assets into 5 categories: Digital commodities Digital collectibles Digital utility assets Stablecoins Digital securities ⚖️ Key takeaway: Only digital securities would fall under federal securities laws. The other categories would not. 🔄 Thorn says this effectively pushes aside the old 2019 “investment contract” approach, creating clearer legal boundaries for crypto assets. 🪙 The guidance also suggests some tokens can stop being treated as securities if: the issuer completes core governance duties, the project is abandoned, or the issuer goes silent for a long period. ⛏️ Important win for crypto: airdrops, mining, and staking are generally not viewed as securities transactions, and simply repackaging a token does not change its legal status. 🏦 Thorn believes this could improve clarity for institutional investors and open the door to a more constructive US crypto policy. ⚠️ But there is one catch: these are interpretive rules, not permanent law. That means a future administration could still reverse them. 📜 That is why the industry is still pushing for legislation like the CLARITY Act to lock in a more durable regulatory framework.
