Why it’s potentially unlawful
• Misleading or deceptive conduct (ACL section 18): Businesses (including event organisers or promoters) must not engage in conduct that is misleading or likely to mislead consumers. Falsely claiming an event is “sold out” creates a false impression of scarcity or urgency. This can pressure people into rushing to buy tickets elsewhere (e.g., resale sites) or making decisions they otherwise wouldn’t. • False or misleading representations (ACL section 29): This specifically prohibits false claims about the availability, quantity, or supply of goods/services (including event tickets). Advertising “sold out” when tickets remain available directly misrepresents availability. accc.gov.au
Similar issues arise with bait advertising rules (ACL), though that’s more about advertising limited stock at a price you can’t reasonably supply. The core principle is the same: you can’t use false scarcity tactics to mislead buyers. nsw.gov.au
