So long as the monetary value is backed by actual provable damages, full stop. At which point the amount in the contract is largely irrelevant, it’s at best a starting point during legal proceedings to determine the actual amounts. It must be compensatory not punitive, and it must be provable and reasonable - you can’t say for example “after his actions we lost $50k in sales so he needs to pay us $50k”, you’d have to prove reasonably that all $50k was directly related to their actions. In addition, you wouldn’t “tack on” anything to the contract issue - contracts won’t decide that, thus would be a separate issue.
