@misumuzi_4 He is conflating two different procedures. One is the SLA that can be signed beforehand and the other is the normal procurement procedures. If there is a lawful SLA signed, his explanation makes sense. But he is wilfully leaving out important parts to make it sound legal.

Justice Madlanga directly intervened to seek clarification on the purpose, timing, and generation of a Purchase Order in the City of Tshwane’s procurement process for the TMPD security services (particularly ad-hoc components of the tender)
Justice Madlanga was not asking a basic admin question, he was testing a core control principle:
Is a Purchase Order (PO) a pre-authorisation tool, or merely an after-the-fact payment mechanism?
That distinction goes to the heart of whether the procurement process was controlled or bypassed.
Mnisi’s Answer implied:
▪️ Deployment letter issued
Services rendered
▪️PO created afterwards
Invoice processed
This effectively reduces the PO to: "A document to facilitate payment after the fact” This is where the red flag emerged.
Why the Commissioner Intervened
Justice Madlanga’s correction was subtle but decisive. The concern was:
A PO is supposed to define and approve:
▪️Scope (guards, vehicles, sites)
▪️Cost
▪️Duration
It must exist before work begins, not after
Otherwise:
▪️There is no prior budget commitment
▪️No real financial control
The system becomes vulnerable to retrospective regularisation
What Should Have Been Said:
A clear and credible answer would have acknowledged both principle and problem. Mnisi should have confirmed that the correct and required sequence is PO before services and invoice.
Mnisi’s actual response created the confusion: he described the sequence as TMPD first issuing a deployment/allocation letter, the service provider completing the work, and only then a PO being generated (followed by the invoice for payment). This reversed the normative order and appeared to align with the irregular post-facto POs that other witnesses had already flagged as problematic in this very tender.
Mnisi’s actual phrasing created the impression that the PO was merely an after-the-fact administrative step to “pay the invoice,” which is the opposite of proper procurement controls
If, in certain instances, POs were issued after services had already been rendered, that would not be in line with prescribed controls and would constitute a deviation from proper process.

Businessman Suliman Carrim has been rushed to hospital after suffering a suspected heart attack while at a gym in Johannesburg this morning.
His current condition has not yet been confirmed.
