I've looked at various videos of the Minneapolis incident and researched some key precedent. This is a new pattern within what I would call reckless vehicular flight, with recklessness and the force of a vehicle weighing thousands of pounds being 100% clear and the intention of flight being a matter of common sense. If she had not been killed, she should have been imprisoned for an extended period of time. She was obstructing law enforcement in the first place, then refused to follow the orders, and used a multi-thousand-pound object for her purposes. But she was killed, and the question is whether it was objectively reasonable to shoot her. It's not a case of a prolonged chase with a fugitive driving at high speeds, partly swerving into oncoming traffic etc. (which would clearly justify all three shots or even 10 or 15 if necessary). But it's also not a case of bloodthirsty officers. They wanted her to get out of the car; they'd have preferred for her never to block the road in the first place. The officer who stood in front of the car was not doing so to provoke the situation. He was doing his job. The one shooting from the side had the right not only to protect himself but also his colleague. What weighs in his favor is that all three shots were fired within 1-2 seconds ("split-second" decisions in each case). So the first shot is a lot easier to justify than the second, and the second is still significantly easier to justify than the third. If she was fatally wounded after the second and the third was found to be illegal, the consequences would be much less severe. The analysis will focus on the totality of the circumstances, which obviously gives both sides opportunities to make their case. That includes the question of what precedent would be set. Both sides can reasonably argue that the outcome they oppose would have problematic ramifications, but from a policy point of view, a guilty verdict would be a lot worse: - Guilty (even if only for the third shot): this would encourage others to engage in reckless vehicular flight, and as a matter of policy, given that people must use multi-thousand-pound objects responsibly, that would pose significant danger not only to law enforcement officers but also to the public. Compared to prior decisions where cars were *retreating*, a higher level of recklessness would be considered non-threatening. If too much emphasis was placed on speed, that would not take into account that electric vehicles can accelerate like motorbikes. - Innocent: fleeing drivers might be shot in many situations where they do not retreat and (exclusively) distance themselves, but are not specifically trying to seriously injure or kill anyone. The U.S. lost a person who was probably mostly a good citizen, but acting grossly unlawfully at least on the last day of her life. Should the U.S. now lose one or two law enforcement officers who were doing their job?
