The sequence today needs to be laid out precisely. Trump nominated Bill Pulte - a housing official with no intelligence background who used his federal post to investigate the president's political enemies - to be acting director of national intelligence. Senate Democrats and several Republicans balked. Democrats made clear they would not vote to renew Section 702 of FISA - the surveillance authority that allows intelligence agencies to collect communications of foreign targets - with Pulte in the DNI chair. This morning the House voted 198-218 against extending Section 702. It expired today. Members left Washington and don't return until June 23. Hours later, Trump announced he is nominating Jay Clayton, the US attorney for the Southern District of New York, as permanent DNI. Clayton has no intelligence background. He is a securities lawyer who ran the SEC during Trump's first term. This week he appeared on CNBC and said California's vote tabulation created "opportunity for fraud" - amplifying election conspiracy theories that have been repeatedly debunked. He was also assigned to probe Epstein's ties to Democrats. He was involved in the flawed Epstein file release. The Senate Intelligence Committee's ranking member said plainly: "I have no idea why the president didn't nominate him yesterday. We could have found a path and Director Gabbard could have stayed on until he was confirmed." A key national security surveillance tool expired today because the president dug in on a loyalist appointment, then switched to a different loyalist after the damage was done. FISA 702 is now expired. The intelligence community operates without it until Congress returns June 23 at the earliest.
