The ABA Section of Labor and Employment Law represents all perspectives of the practice: employer, union, employee, public, and neutral. #ABALEL

Per #abalel panel: The development of the appropriate workplace culture starts at the top with the c-suite. Nothing happens, or changes, if there is no senior buy-in.

Per @KSonderlingEEOC: Employers need to develop appropriate policies to avoid mental health disability claims AND train employees (esp front-line mgrs) on appropriate responses to these issues. #abalel

Per #abalel panel: You want to avoid training fatigue, but it’s also important to be targeted with effective training of supervisors, HR, and c-suite to increase awareness of mental health issues and obligations.

#EEOC Commissioner @KSonderlingEEOC speaking at @abalel conference: Number 1 type of charge filed with EEOC alleges retaliation, followed by disability/accommodation-related allegations. Mental health and remote work continue to be big areas for Ers to address. #abalel

Per #abalel panel: Even if employee tells manager “I’m about to tell you something, but I don’t want you to tell anyone,” the company is likely still on notice of the issue. Very important to train those managers about what to do in that situation.

Per #abalel panel: “Direct threat” defense to #ADA claims is not simply thinking an employee is acting “different” or “strange.” Must at least be a threat to health or safety of the employee or others.
