Reasons: Noble explained in evidence that immediately before he bumped Edwards, Edwards’ right foot slipped, which resulted in the lowering of Edwards’ body. This is supported by the vision. Without Noble's evidence, it is difficult to understand from the vision alone why high contact was made in the awkward way it was. Having carefully listened to Noble's evidence, and watched the vision again, we accept Anderson's persuasive submissions that but for Edwards’ unforeseeable slip it is probable that Noble would not have made high contact, and that the bump would have been to the body. Noble is shorter than Edwards and at the time he commenced the bump, both of his feet were on the ground. The vision shows that before the slip, Noble's shoulder was not at Edwards' head height. We consider that in the unusual circumstances of this case, the high contact was caused by circumstances outside of Noble’s control which could not be reasonably foreseen. For these reasons, the charge is dismissed.
