Starting to watch the #NottinghamInquiry slightly late so am running an hour behind! First impression: I'm wondering what families make of those whose leadership they've criticised having been promoted since the events under consideration.

@asifamhp Of course, the ICB should always be asking anyway, to check they are meeting their statutory s140 obligations.

I would suggest that the Director of Commissioning @ the ICB should know & the fact that they don’t know, say quite a lot about the state of things✔️ BTW it takes one phone call to the Bed Manager to ask the question & get the answer✔️>

“…where patients have been sectioned under the Mental Health Act but remained at home due to a lack of beds.” *They have not been detained aka “sectioned” that’s the point! They remain at home or in EDs or cells etc subject to no legal framework to keep them & sometimes >

It can’t & shouldn’t be a policy (& it is in some places) & it shouldn’t be the custody Sgt or Inspector telling an officer to utilise the power. >

I'm genuinely FED UP of hearing the same non-legal myths trotted out int the face of actual evidence. The L&D witness states it would be "inappropriate" to use ss2/3 to admit VC to hospital - it would mean admission to non-secure, non-forensic bed. WRONG! #NottinghamInquiry

@WhippGary @FionaNaylor2 @MentalHealthCop They have a fair amount of (delegated) power & decision making authority. But not once does the MHA mention a Bed Manager. They exist because of the bed issue & because Drs didn’t want the responsibility/hassle.

@asifamhp @FionaNaylor2 @MentalHealthCop As a carer my perception, from what I know of the service/system, is the Bed Managers control the service/system.

Legal Literacy is not what it should be✔️ NHS Policy/Practice is not the law *Even if a big 🧀 manager or Dr says so✔️ @MentalHealthCop “How dangerous is this very wilful kind of ignorance?! – it amounts to a failure to learn lessons already available to us.”

@scousepie @MentalHealthCop >thats the legal thing. The NHS can say no & that responsibility sits with them & they can explain themselves & the nonsense to the coroner etc.

@scousepie @MentalHealthCop “Gatekeeping” assessments r about “beds”… CAMHS/NHSE do it & increasingly MH Trusts - usually by an on-call “senior Dr” who won’t have seen the patient. It’s not legal a thing. If there r 2 valid (or joint Med Rec) & an #AMHP willing to make an application >

Blog written after today's #NottinghamInquiry - we heard why no MHA was done but there's a contradiction - a) it wasn't needed; but also b) they couldn't access the correct type of bed given the risk. But you don't need a bed if he doesn't need to be assessed. Out tomorrow.
