The SEC just filed its opposition to @coinbase's mtn for judgment on the pleadings. The SEC is wrong again. They make the sweepingly broad assertion that any investment w/ an expectation of profit is a security (e.g., page 8). As mentioned (see below tweet), if we apply that flawed logic to real life, that would mean that if I purchase a basketball card and hope to turn a profit based on Upper Deck's efforts, that would turn my purchase into a securities transaction regulated by the SEC. (And, yes, @kobebryant is still the 🐐.) We need smart, sensible legislation to provide the clarity that the digital asset industry needs to best protect consumers while allowing for responsible innovation (FIT21). x.com/_jikim/status/…

Who’s heard of ACT for ALS? 🙋🏻‍♀️ We are expecting $75M to expand access for treatments to PLWALS who are not eligible for clinical trials. But are we going to get it all as promised? It’s looking dicey @NIH

Just a reminder that ALS is currently a 100% fatal disease. As such, any treatment that is safe and slows down or stops progression for even one patient is a victory for all of us.

6/ While Gemini is encouraged by the level of engagement and increased commitment to crypto by this administration and Congress, there is more work to be done. It is critical that the US leads when it comes to thoughtful policy that both protects consumers and fosters innovation.

4/ The reports submitted also fail to fully appreciate that crypto can dramatically improve our existing financial system. Crypto has the power to transform our financial system by eliminating unnecessary intermediaries and increasing access and participation.

“Work hard and in silence, then let success make the noise”. (Miguel McKelvy). Appreciate life and work can often be hard but I like that quote a LOT. (Our mantra, less pithy, has always been: put your head down, focus on quality of output and outcomes. Good gets found out.)

Tomorrow we have the chance to make history. If the @US_FDA Advisory Committee recommends approval for AMX0035 it will be set to be only the third drug EVER approved to treat ALS, my 100% fatal disease. It is safe. It extends life. It should be approved. Now.
