A few things that make this F-up even more notable • The developer here, Nathan Berman, is the poster child of these kind of large-scale, complex office-resi jobs. There is no one in the city w/ more of a track record and pipeline (incl. an even more $$$ conversion at 111 Wall) • Berman's firm, Metro Loft, tends to self-perform – i.e. they're usually the GC on their jobs (incl. here) • Berman's firm also has a close r'ship w/ the construction manager, CCM (the chatter is that they own a piece of CCM) So unlike some other major developments, the chain of responsibility here starts, and ends, with Berman gothamist.com/news/engineer-…

One would have to imagine that President @realDonaldTrump’s phone has been ringing off the hook. The practical reality is that there is insufficient time for him to make deals before the tariffs are scheduled to take effect. I would therefore not be surprised to wake up Monday with an announcement from the President that he was postponing the implementation of the tariffs to give him time to make deals. President Trump has gotten the world’s and our trading partners’ attention and elevated the importance of resolving an unfair tariff regime that has harmed American workers and decimated our industrial base over many decades. This is a critically important issue that needs to be resolved, and we finally have a president committed to getting this done. The problem, however, can’t be resolved in days, so why wouldn’t a pause make sense to give the president time to properly resolve this critical issue and to allow companies large and small the time to prepare for changes in their supply chains? The risk of not doing so is that the massive increase in uncertainty drives the economy into a recession, potentially a severe one. One thing is for sure. Monday will be one of the more interesting days in our country’s economic history.

@antonia_mdprjct @aussieflya @mrfboyer It *could* include gen conditions (if fixed); fee; shared savings (accrued to contingency, if realized on early buy-outs) etc. Just saying, a well written GMP contract, with a knowledgable Owner (and semi-reputable CM), can remove almost all risk from a job.

More on this: If you hit your GMP max number and think the GC will finish your project just because there’s no more budget and you have a contract, you’re gonna be in for a bad time. A GMP only matters to large firms. Small to medium sized guys will walk.

@antonia_mdprjct @aussieflya @mrfboyer Talking contract delivery method here? GMP: could be “at-risk” or “at-agency”; fixed fee, reimb gen cond, shared savings, etc vs GC Lump Sum. GMP lets owner to determine risk he wants to take (when to buy, what subs to buy, etc) Lump sum is plans and specs with deep pocket GC.

Another week, another crappy operating agreement written by an attorney who has no excuse. It's a two-member LLC (each w/ 50% ownership), and yet there is no deadlock provision and several things that require a vote of a "majority in interest." How TF do you get a majority in interest in a 50/50, two-member LLC? Straight-up malpractice in my mind.
