Because I haven't made any procedural errors, and my lawsuit does not seek anything that SCOTUS hasn't already said is my right. When Judge S. James Otero issued a final judgment in favor of the State of California on May 1, 2014, he said that I couldn't challenge the constitutionality of the law as it applies to me or to anyone else. He said I can only challenge the constitutionality of California's Open Carry bans as they apply to everyone, even though my operative complaint explicitly excluded that. He did not give an example of where California's Open Carry bans are constitutional as applied to anyone. The Peruta v. San Diego concealed carry lawsuit, and a couple of other concealed carry lawsuits, were already on appeal, but even though my lawsuit was an Open Carry case that did not seek concealed carry, my appeal was placed on hold until the final decision in Peruta v. San Diego (2017). At that point, there was the Young v. Hawaii lawsuit, where the Plaintiff-Appellant, George Young Jr., sought a permit to carry a handgun. He did not care if the permit was for concealed or Open Carry. The district court judge in his case held that the Second Amendment right to keep and bear arms was limited to the inside of one's home. Although I tried to have my case argued and decided before the same three-judge panel in Hawaii, the powers that be wanted the Young v. Hawaii appeal decided by the three-judge panel assigned to my appeal in California. The lawyer for the State of Hawaii did not want to travel to California, and so the two appeals were argued and submitted before two different three-judge panels. Because Young v. Hawaii was argued and submitted to its panel three days before my case was argued and submitted on February 15, 2018, I would have to wait for the final decision in Young v. Hawaii, because when a case is argued and submitted, its decision is binding on subsequent three-judge panels. The final decision in Young v. Hawaii did not occur until 2022. In September of 2022, the final judgment of Judge Otero in favor of the State of California was vacated, in full, and my case was remanded back to the district court for "proceedings consistent with NYSRPA v. Bruen." On remand, Governor Newsom and AG Bonta took the position that the district court did not have to comply with the 9th Circuit's order, a position to which the magistrate and district court judges agreed. I went before the 9th Circuit Court of Appeals once again for a decision on my petition for rehearing/rehearing en banc, in which I explained that the district court was refusing to comply with the Order of the 9th Circuit Court of Appeals. My petition was denied. I then filed a cert petition before final judgment with SCOTUS. It too was denied. The short answer is that for me to lose, the district court and the 9th Circuit Court of Appeals would have to hold that I do not have the right to carry loaded and unloaded handguns and long guns in the curtilage of my home, a place as protected by the Second Amendment as the inside of my home. The Supreme Court in District of Columbia v. Heller invalidated a prohibition on carrying loaded rifles, shotguns, and handguns inside the home, in the curtilage of the home, and on private residential property because the law prohibited the carrying of loaded firearms inside the home. And so, I once again find my lawsuit in limbo, waiting for the final decision in Baird v. Bonta. DHS says Walvin Victor Hugo Garcia had been arrested in June of 2025 for felony charges of rape of a child less than 13 years of age, aggravated sexual battery of a victim under 13 years of age, use of a computer to commit sex offense with a minor, and distributing drugs to a minor. DHS says following his initial arrest in June, ICE lodged a detainer asking "Fairfax County sanctuary politicians to not release this illegal alien from jail back onto the streets. Unfortunately, sanctuary politicians REFUSED to cooperate with ICE. Garcia was allowed to leave court without ICE being notified." “Governor Spanberger and her fellow sanctuary politicians in Fairfax, Virginia refused to cooperate with ICE and RELEASED this child rapist from jail back onto the streets,” said Acting Assistant Secretary Lauren Bis. “This criminal illegal alien from Guatemala has been charged with raping a child under 13, aggravated sexual battery of a victim under 13, and distributing drugs to a minor. Virginia Tech’s “this was not an official campus event” dodge is weak. An off-campus party is not an “official campus event” either, but if something dangerous happened there involving students, the university would not shrug and say it had nothing to do with them. This event was held on campus, hosted by students and alumni, aimed at Virginia Tech students, and featured rhetoric designed to radicalize them and normalize political violence. That is a campus safety problem. And personally, considering Virginia Tech has no problem using university resources for all kinds of unnecessary programming — forcing new students through budgeting modules, trans-awareness trainings, body-image lessons, and even creating special housing programs based on identity — it is fair to ask why the university suddenly becomes helpless when students are exposed to extremist messaging on its own campus. The big ask is simple. Virginia Tech should train students to recognize when outside actors are attempting to radicalize them. The easy ask is even simpler. Virginia Tech should do its job and treat this as the public safety issue it clearly is.
