There is a player somewhere right now whose club has not paid him in four months. He is still training, showing up and performing. And he has no idea that FIFA regulations give him the legal right to terminate his contract, walk away, and sign elsewhere without owing a single euro in compensation. He does not know because nobody told him. This series is for him. Refer them to me if you know any. But let's start from the beginning. Article 13 of the FIFA RSTP says a contract between a professional and a club may only be terminated upon expiry of the term or by mutual agreement. Generally, if one party- player or club wants to unilaterally terminate a contract, they have to pay the other party the remainder of the contract. For example, if I have a 5 year contract with a club at $1m per year, and I want to leave the club after my second year. I have to pay the club the equivalent of the remainder of the contract which in this case is $1m dollars for each of the last3 years, which makes a total of $3m dollars. If it was a club that wanted to send me away as well, they have to do the same. That's why you sometimes hear the term "they have bought out his contract". It means the party that is terminating the contract is paying the other party to terminate the contract. Do you understand? That is the baseline rule. As in the general principle. It upholds the fact that contracts must be respected. But the RSTP also recognises that real life is more complicated than that, which is why it builds in mechanisms for legitimate termination. There are three routes worth understanding: -termination with just cause -termination with sporting just cause, and -termination without just cause. Each one has completely different consequences. Let's start with Just cause. Article 14 of the Regulation on the Status and Transfer of Players permits either party to terminate the contract without any financial or sporting consequences where just cause exists. The RSTP defines just cause as any circumstance in which a party can no longer reasonably and in good faith be expected to continue the contractual relationship. The regulations deliberately avoid giving an exhaustive list, because just cause is assessed case by case. But in practice, the most common and most important ground is unpaid wages. Article 14bis is the specific provision for this. If a club fails to pay a player at least two monthly salaries on their due dates, the player is deemed to have just cause to terminate, provided he has first put the club in written default and given them at least 15 days to pay. Two months of unpaid wages, written default and fifteen days notice. Those are the three requirements. If you miss any one of them, the player's termination becomes much harder to defend. NB: The written default is not optional. It is a legal prerequisite. A player who walks away without sending that formal notice first will find himself in a much weaker position before the FIFA Football Tribunal, regardless of how badly the club has behaved. Article 15 gives players another ground that is often overlooked entirely. It is called sporting just cause, and it exists to protect professional players from career stagnation. If an established professional has appeared in fewer than ten percent of his club's official matches during a season, he may terminate his contract prematurely on sporting just cause grounds. The termination can only be made in the 15 days following the last official match of the season. No sporting sanctions apply in this scenario, though financial compensation may still be payable depending on the circumstances. Now let's talk about what happens to clubs that delay payments. There is a separate mechanism for this beyond just cause termination. Article 12bis of the RSTP gives players an additional tool. Where a club has delayed a payment for more than 30 days, and the player has put the club in written default with a minimum of 10 days to comply, the player can request FIFA's intervention and seek sanctions against the club. The sanctions available include warnings, reprimands, fines, and transfer bans. This means a player does not have to terminate his contract to get relief. He can use Article 12bis to pressure a club into paying while keeping his contract intact. One thing the document handed to you says that I want to be precise about. It states that the burden of proof falls on the club to demonstrate it has fulfilled its financial obligations. That is correct. If a club cannot show evidence of payment, the FIFA Football Tribunal will generally find in the player's favour. A real life example of this is Matuzalém Francelino da Silva. Matuzalém was playing for Shakhtar Donetsk when he unilaterally terminated his contract and joined Real Zaragoza. He argued just cause, relying on contractual instability and issues around the club’s conduct. The matter went before FIFA bodies and eventually CAS. While the case became more famous for the compensation that followed, it is important because it confirmed a key principle under Article 14. Where just cause is established, the player is entitled to terminate without sporting sanctions. And what's more, he can get the remainder of his contract's wages. That is the core takeaway. The DRC consistently protects players where there is a fundamental breach by the club. Typical successful Article 14 scenarios include persistent non payment of salaries, abusive working conditions, or unilateral contract changes. This is getting too long. We will continue tomorrow. @israel_ajoje You're comparing mbappe who's arguably top 5 best player in the world to players who are struggling to find their foot in professional football. If mbappe sues the whole of France today he'd still have teams to play for. An average player cannot make that gamble.

@boss_aimarr Do you have an experience with a similar case? Cos even at top level, Mbappe sued PSG and is still playing for Madrid. There are many players at this level that sue their clubs over contractual issues and found another club soon after.

By every logical means. Top of the reason being his exceptional availability. He’s always there. He’s always fit. Secondly, he has played at the World Cup which in my opinion is one of the highest levels you can attain as a Super Eagles player. He’s made an AFCON final, which is not a common thing too, and he’s going to be a Super Eagles centurion. Also, he’s one of the few Nigerian players who’s consistently played at a good level.

Okay we don't support two clubs per se We have a main club where the bangers happen and a side club where we increase our banter reach. For example a madrid fan most likely supports man united . This gives him the extra mile needed to banter arsenal directly

I always feel like I don’t even love Barcelona enough, and then I see people loving and backing two teams and I’m just confused cos I can’t!!! This club is the club of my life.
