Earlier today, Amb Strickland (@Str1ckFran) put in @AOSISChair's submission to the @CIJ_ICJ Advisory Opinion on Climate Change. RMI and PIF were also submitting at the same time. SIDS continue to shape IL on critical issues!

@DrSimEvans @mariluomi @JenIrisAllan Lots of (un)constructive ambiguity in that decision. 1st para reminds of nationally determined nature of NDCs. Negotiators that I've talked to say that the decision does not mandate 5 year timeframes.

@mariluomi @brycerudyk @JenIrisAllan Time will tell indeed! Like Mari, I also interpreted the decision in combination with what was agreed at COP24 re the period from 2031 onwards to mean 5yr timeframes, but perhaps this is another case of constructive ambiguity in the text…

Question to international climate lawyers and other #UNFCCC experts: Is there a list of the bindingness/strength of verbs anyone could share? The CTF decision uses 'encourages', which seems a lot weaker than the 1/CP.21 'requests'. But how much exactly? #COP26

@mariluomi @JenIrisAllan It doesn't mandate the length--couldn't agree on specifying that. So clever solution was to specify end date. As all current NDCs have 5yr delay, then 10yr period ('25-'35) minus 5 yr delay = 5 yr NDC. But 5yr delay isn't mandated, so possible 10yr NDC in '25 running until '35.

@JenIrisAllan @brycerudyk As I understand it, the new decision mandates 5-year timeframes: 2031-2035 and 2036-2040 etc. And I am also mainly worried about the strength of the verb.

@mariluomi @JenIrisAllan They are speaking to different aspects of NDCs. 1/CP.21 = frequency of submission. CTF = end date as proxy for length of NDCs. So, no conflict between requests and encourages, but not great that CTF is only encouraged.

@mariluomi @UNFCCC has a drafting style guide that lists the verbs, but not sure if it's public. Requests is usually used for legal obligations and invites/encourages/urges is usually for non-legal/non-obligations--but not always

@MatPaterson @JenIrisAllan @IISD_ENB I think that we need to consider the COP/CMA decisions as legal texts, not just political ones. COP Prez writes grand political rhetoric, but Parties interpret their obligations based on their legal interpretation of the highly negotiated words!
