Today’s Supreme Court decision effectively guts a key pillar of the Voting Rights Act, freeing state legislatures to gerrymander legislative districts to systematically dilute and weaken the voting power of racial minorities - so long as they do it under the guise of “partisanship” rather than explicit “racial bias.” And it serves as just one more example of how a majority of the current Court seems intent on abandoning its vital role in ensuring equal participation in our democracy and protecting the rights of minority groups against majority overreach. The good news is that such setbacks can be overcome. But that will only happen if citizens across the country who cherish our democratic ideals continue to mobilize and vote in record numbers - not just in the upcoming midterms or in high profile races, but in every election and every level.

Update Erika Girardi pretrial conference: The court would not allow electronics in so we’re reporting it now. The sale is nearly complete. $900,000 was paid on Monday, and the remaining $900,000 is expected to be paid today or tomorrow, with closing anticipated by Monday at the latest. The Court directed Plaintiff to file a brief by Monday establishing jurisdiction, including the citizenship of the entity and all of its members. The Court also requested clarification that all pending claims are properly included in the sale, along with th bankruptcy court order. With respect to substitution of the plaintiff, the Court indicated this can be done by motion or stipulation and does not appear to believe the substitution will impact the underlying claims. The parties were ordered to meet and confer and agree that all claims will survive the transfer. Defendants’ ex parte application seeking discovery related to substitution was denied. This could’ve been an objection to the sale. The Court found there is no basis for additional discovery (as discovery is closed) and no basis for a continuance. The pretrial conference has been continued to May 7 at 1:30 p.m. The Court noted that trial documents were already due and expects the parties to be fully prepared by the time of the pretrial conference. The court denied Erika’s application to continue the trial. Also, the court denied her request to take discovery of the buyer. Her legal team is going nuts. More to follow soon…

🚨🚨🚨Breaking: Erika Girardi files emergency motion to continue the trial. She contends she needs to know who the buyer is, whether the court has jurisdiction over the case now that it has been assigned, and a request for limited discovery. The buyer is from Colorado and Erika is from California so there is diversity jurisdiction at a minimum. Typically courts apply jurisdiction at the time of filing but this and other issues will be decided immediately. I agree, the buyer should get new counsel into the case immediately.
