If you live in a community property state (Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, Wisconsin) your spouse may be responsible for debt acquired during the marriage. And federal student loans are discharged at death entirely Everything else dies with you. That credit card balance, that medical bill, that personal loan. Gone. The estate handles what it can and the rest disappears But the collectors won't tell your family any of this. Because a confused grieving person with a checkbook is the most profitable customer in the entire debt collection industry. There's no urgency like funeral urgency. There's no compliance like grief compliance I talked to a woman whose husband died in 2024. Collectors called her 11 times in the first two weeks. She paid $23,000 across four accounts before she talked to anyone who told her she didn't owe a single dollar of it. The accounts weren't co-signed. Her state wasn't community property. She just paid because a man on the phone told her she had to during the worst month of her life If someone you love dies and a collector calls: Say this: "I am not the debtor. Send all communication in writing to the estate executor. Do not contact me again by phone." Then hang up. Under the FDCPA they must stop calling you once you request written communication only.
