The NCAA thinks it is so smart. I bet they're patting themselves on the backs in Indy. "If we only penalize coaches and schools, we avoid getting sued left and right by players." Except that the overarching intent is to indirectly restrict individuals from earning an education at the institution of their choice. This, like many other policies, wasn't fully vetted by smart lawyers.

NCAA eligibility rules are getting harder to defend. Be drafted by an NBA team, traded multiple times, play pro for years → eligible for NCAA (if you never enrolled in college). Do the same AFTER some college → ineligible forever. Once the NCAA allowed G League players in, the door opened, and the distinction between pro contracts likely won't survive continued legal scrutiny. linkedin.com/pulse/newslett…

@DanWolken The schools would rather have this mess than a CBA. They don’t want to give up half the revenue.

One overarching comment here that applies to both the Ole Miss/Clemson situation and the Alabama basketball situation: The people in charge of college sports have built their systems on A) Hoping/believing that most people act ethically and B) They will accept the consequences if they don’t and get caught. Neither of those things have been true for decades. So here we are. And yet the same people in charge now will come up with the next thing and the next thing and the next thing and none of them will work without a CBA

@RossDellenger The fact that he is an advisor to UM's collective and represents a player who is likely bound to UM seems at odds.

Darian Mensah’s counsel, Darren Heitner, says a judge today denied Duke’s request that Mensah be enjoined from entering the transfer portal. The judge, a Duke basketball season ticket holder, recused himself from future proceedings, Heitner says.
Ross Dellenger@RossDellenger

An expected move as Duke officials had made no financial settlement offer to Mensah or his representatives. A legal fight ensues - something that’s becoming a hallmark of the new college sports era.

@heitner @AllKindsWeather The NCAA and the schools don’t want them to be employees becuase the can unionize and collectively bargain. The first thing they will ask for is 50% of the money

Agreed. But these coaches are employees. Schools don't play the song and dance where they hand coaches "NIL Licensing Agreements," that specifically state payment is not for services provided. I agree that college athletes should be deemed professionals. Schools, conferences, the NCAA, and CSC do not agree.

lol Hey @heitner: coaches often have non-compete clauses in their contracts. Which basically means “sure you can leave us to go to a rival school if you want, but you’re gonna pay us a LOT of money to do so.” Since college athletes are legitimately professionals now, how do we get to a point where we install these clauses into athletes’ NIL contracts?

@heitner @DanWolken You need to create a true off-season. Signing day, portal, coach movement. Tampering/ contact with coaches should be against the rules and enforced

Everyone in college sports knows the solution, they just don’t have the stomach (yet) to execute it. Until then, there’s no point indulging the complaints.

Eli Drinkwitz says CFB is sick right now and says there are signs that the sport is cracking: "Tampering is at the highest levels - there is no such thing as tampering, because there's no one that's been punished for tampering. "Everyone on my roster is being called."
