A couple of people have suggested, instead of having Senators and Congressmen request President Trump award Maj Capers the Medal of Honor, we should just use the bureaucratic process. Unfortunately, the process to address Maj Capers being awarded the Medal of Honor failed this Marine multiple times over due to corrupt individuals within the system. This is not an attempt to circumvent the process. It is actually taking action to correct an injustice. ■■■ Maj Gen Hochmuth To begin with, in 1967, Maj Gen Hochmuth, CG, 3rd MARDIV initiated the proposal of the Medal of Honor for Maj Capers after meeting with each of the Marines who were with Maj Capers at Phu Loc. Each of Maj Capers' Marines credited Maj Capers’ actions, courage, and selfless leadership with the reason they were all alive and felt Maj Capers was deserving of the Medal of Honor. Maj Gen Hochmuth told Maj Capers he would receive the Medal of Honor, while Maj Capers was recovering from his wounds in the hospital. Unfortunately, Maj Gen Hochmuth died in a helicopter crash before ensuring Maj Capers received the Medal of Honor. ■■■ Maj Capers' Company Commander Tragically, Maj Capers Company Commander, who disliked Maj Capers immensely, for whatever reason, and who was not at Phu Loc, decided instead to award Maj Capers the Bronze Star with combat "V." ■■■ Maj Gen Williams Years later, Maj Gen Williams directed an inquiry to determine what occurred at Phu Loc and whether Maj Capers deserved the MoH. Upon conclusion of the inquiry, Maj Gen Williams also felt Maj Capers deserved the MoH. However, at the time, like most Marines, he felt it best to use the process and to trust the system. ■■■ Marine Corps Awards Board The Marine Corps convened an Awards Board in 2010. The Awards Board determined Maj Capers should have his Bronze Star with combat "V" elevated to the Silver Star Medal. When Maj Gen William requested to see the minutes of the awards board to understand the Board's decision, he found that the Board had not retained its minutes. A MoH Awards board is a statutory board. This means, legally, the minutes must be retained. Without those minutes providing transparency, it is impossible to know why a board would deny a MoH. ■■■ Maj Capers' Company Commander... again In addition to no minutes, Maj Gen William found that the same CO who disliked Maj Capers in Vietnam was now in charge of the Manpower Branch overseeing Awards. And the head of Awards was one of the former CO's subordinate Marines with whom he had maintained a close relationship. There is good reason, and evidence, to believe the two colluded to ensure Maj Capers would not receive the MoH. ■■■ Secretary of the Navy... 1st Attempt When Maj Capers MoH recommendation was later elevated to the Secretary of the Navy, Secretary Del Toro, it was shot down based upon the fact that it was procedurally incorrect. The recommendation addressed many events during which Maj Caper demonstrated heroic actions while executing over 50 combat missions with 3rd Force Recon in Vietnam. Per the order, the MoH must only recognize one event. ■■■ Secretary of the Navy... 2nd Attempt The MoH recommendation was repackaged and resubmitted correctly, focusing solely on one specific event - Maj Capers actions at Phu Loc. Secretary Del Toro, again shot down the recommendation. This time stating Maj Capers' recommendation had already been reviewed and denied. However, it was initially denied based upon a procedural error (multiple events as opposed to one event), not based upon an assessment of Maj Capers' actions. ■■■ Awards Board Obstructionist While it is still not clear, it is quite likely the same person who had a disproportionate amount of influence over Secretary Del Toro's decision to block SgtMaj Canley from receiving the MoH, was also the one who influenced Secretary Del Toro to reject Maj Capers from receiving the MoH. After a detailed investigation of SgtMaj Canley's case, the individual who wrongfully influenced Secretary Del Toro's decision was identified as the sole obstructionist, without any substantiating evidence. President Trump corrected that injustice by Awarding SgtMaj Canley the Medal of Honor in 2017. ■■■ Political Quid Pro Quo More recently, other individuals with significant political influence, who recognized Maj Capers was deserving of the MoH, offered to ensure Maj Capers would receive the award. In return Maj Capers would have to use his "15 Minutes of Fame" to elevate a false political narrative. Despite waiting decades for the MoH and wanting to receive it, not just for himself but for those with whom he served and all Vietnam Veterans, Maj Capers refused their offer. As such, they withdrew any support and may still be working behind the scenes to prevent Maj Capers from receiving the MoH. ■■■ Congressman Norman & the NDAA When all of this was brought to Congressman Norman's attention, he entered a Congressional Record recognizing and honoring Maj Capers life. He then entered Maj Capers MoH nomination into the 2024 National Defense Authorization Act. The House of Representatives voted on and approved the bill with Maj Capers MoH nomination included. However, for some yet to be determined reason, Maj Capers MoH nomination was stripped out when it went to the Senate and never made itinto the final NDAA. ■■■ Long Process, Same Results Some may still feel Maj Capers MoH nomination should again go through another lengthy bureaucratic procedural review, simply to "validate" the award. However, if the process is not again polluted by individual obstructionists motivated by personal, bureaucratic, political, or other issues, it would arrive at the same conclusion which has already been "validated" by two Maj Generals, all of Maj Capers' Marines who were with him at Phu Loc, and nearly every other person who has reviewed the witness statements: Maj Capers is deserving of the Medal of Honor. Maj Capers' Platoon Sergeant from Vietnam even stated, "Maj Capers doesn't deserve the Medal of Honor. He deserves two Medals of Honor." Having bureaucrats "validate" the award makes Major Capers actions no more real nor any more heroic. ■■■ *Maj Capers' Health* Of significant concern, should the bureaucrats require Maj Capers MoH nomination go through yet another bureaucratic process, simply for additional "validation," it will only delay the inevitable. Yet, that delay might quite possibly lead to Maj Capers, who is now 87 years old and whose health is failing, receiving the MoH posthumously. ■■■ Justice Presently, six Senators - Graham, Budd, Tillis, Sullivan, Sheehey, and Tim Scott (more pending) - and dozens of Congressmen (more pending) want to see this injustice rectified and Maj Capers awarded the MoH while he is still alive. They intend to recommend President Trump award Maj Capers the Medal of Honor as soon as possible. With God's help, we will make it happen.
