Reps. Troy Carter and Cleo Fields, the two House Democrats who represent the only two majority-minority districts in Louisiana, responded Wednesday to the Supreme Court's ruling in Louisiana v. Callais. The high court upheld a lower court ruling that found Louisiana mapmakers relied too heavily on race when they redrew the state's voting boundaries to comply with Section 2 of the Voting Rights Act. Both lawmakers had expected their primaries to proceed next month, but the state’s secretary of state has put all House primary races on hold following the decision.

Today the Supreme Court issued a 6-3 ruling in Louisiana v. Callais that effectively ends Section 2 of the Voting Rights Act as a practical enforcement tool for redistricting. The ruling effectively invalidates Section 2 of the VRA as it has been understood for four decades without explicitly striking down the statute. It now requires proof of intentional discrimination - something Congress did not write into the law and that is extremely difficult for plaintiffs to show. This is the history Kagan's dissent traces. In 2013, the Supreme Court gutted Section 5 - the preclearance mechanism requiring states with histories of voter suppression to get federal approval before changing voting laws. A flood of discriminatory voting laws followed. In 2021, the Court weakened Section 2's application to ballot access restrictions. Today, the redistricting enforcement mechanism falls. Congress amended the Voting Rights Act in 1982 with explicit bipartisan intent: to make it an effects test, not an intent test. Discriminatory intent is always hidden behind plausible neutral justifications - protecting incumbents, drawing compact districts, partisan goals. Congress said: we don't care what you call it. If minority voters end up with less political power, that's a violation. Today's ruling says: partisan justification is enough. As Kagan wrote in dissent: "The new Callais requirements will effectively insulate any practice, including any districting scheme, said by a State to have any race-neutral justification." According to analysis, the ruling could eventually lead to Republicans flipping as many as 19 majority-minority seats currently held by Democrats. Florida acted within hours.
