The Tshwane street name case is one of those horrible cases of constitutional contrivance. It takes obvious (actual and constitutional) reality and twists and turns it into something depraved. The Court specifically targeted the Afrikaans community and virtually says outright that it it is intolerable for them to use the Constitution to protect their heritage and culture. The Court also (and this is my entire LL.D. thesis) participated in the ridiculous fabrication that the "entire Constitution [imposed on everyone] the duty to transform". This totalitarian vision is on its face false, and an opportunistic reading of plain constitutional language. No constitution would provide for the protection of cultural rights (like ours does) but also implicitly and in blink-and-you-miss-it woo-woo ways sanction the cultural reengineering of the whole society by a tiny political elite. Trash jurisprudence. The Court's status alone does not make it respectable, any more than the judgments of the Appellate Division that came before.
