The only conservative justice to oppose the deeply evil decision was Neil Gorsuch whose surprisingly pro-native opinions are the sole bright spot in his otherwise detestable judicial career. Gorsuch pointed out that the tribe was not seeking some kind of dramatic change, but was merely asking the government to identify its water rights — a crucial requirement for their continued survival. Credibly accused sexual predator Justice Brett Kavanaugh wrote the majority, stating that: "In light of the treaty’s text and history, we conclude that the treaty does not require the United States to take those affirmative steps" and "it is not the Judiciary’s role to rewrite and update this 155-year-old treaty.” The Navajo Nation has faced persistent problems trying to get water infrastructure to keep their people alive and secure.
