@ErnMarkham @EDOLawyers The decision of the NT does have a relationship with the Commonwealth by virtue of the recommendations in the Pepper Review which fall within control of the Commonwealth, particularly a recommendation the “water trigger” apply to NT Gas projects. This, to date, hasn’t occurred.

Today the NT Supreme Court is hearing a crucial test case on the calculation of mining security bonds. In this instance the case relates to the McArthur River Mine - but mine rehabilitation and who ultimately carries the cost is a nation-wide issue of real importance.
