I don’t think that is the true position of the law: Section 233 of the CFRN says: (1) The Supreme Court shall have jurisdiction, to the exclusion of any other court of law in Nigeria, to hear and determine appeals from the Court of Appeal. It doesn’t say “only hear appeals..

@olayinka_pen @sen_adekunle “Counsel, if we want to go that route, what law creates this court? Open to section 233, can this court hear appeals from any other court other than the Court of Appeal?” There were 3 other attempts. I even tried section 13 of the LPA for a directive or something

@dnnams @sen_adekunle Exactly and by saying they only hear appeals from CA by virtue of S.233 they are limiting their role already. I hope the profession will react and create an alternative because I believe LPDC alone can't be the final Panel.

@sen_adekunle @olayinka_pen I agree with this to an extent. The SC as a regulator has the same powers as the BoB with regards to discipline of lawyers. Also traditionally, when we are called, we become Barristers and Solicitors of the SCN.

@dnnams @olayinka_pen But the SC has never been a regulator of the profession. What they do is to hear Appeal from LPDC before now. The body of benchers is the regulator and not the SC as a court.

@dnnams @sen_adekunle That's actually the true position of the law, but I am concerned with the fact that SC has heard an appeal from LPDC before and jurisdiction was exercised based on that LPA Section, now they are changing the position. With this now, is LPDC the final panel?

@sen_adekunle But I think Section 12 sub 7 of the Legal Practitioner Act allows any Legal Practitioner who is not satisfied with the decision of LPDC to SC within 28 days🤔, unless the new LPA has been passed to Law.

This is what this same Supreme Court said just last year April. I wonder what will now happen to the “means of livelihood” of the lawyers whose fate is now in limbo because there’s nowhere to appeal to.

In my last year article, I’d explained that: The BOB Appeal Committee is inexistent, and the implication is that the LPDC decision is final. This can only be remedied when the committee is established (I doubt it will) or by statutory intervention x.com/theidlawrence/…

At the Supreme Court on Wednesday we were all advised by My Lord the presiding justice to withdraw our pending LPDC appeals. There is currently no recourse for practitioners after LPDC. This needs to be addressed by the profession immediately.

@tunmishe_ Yes. In the matter just before mine, the CJN had constituted the full panel and invited counsel to address the court on jurisdiction. However, he didn’t even let them go into this. Advised everyone to withdraw their appeals. It didn’t help that in the first matter…

If you don’t know the backstory of this, let me brief you. Remember Ben White was very hot in that 22/23 season and was regularly called to the England National Team. There were rumours that he would never play ahead of Walker and Trippier back then. There were also rumours he had an issue with Steve Holland (assistant coach) especially. Ben White was angry and left Qatar in 2022. He made up his mind not to play for England as long as Southgate was manager. I’ve seen an interview where Southgate was asked about not inviting him, Southgate said White is the one who’s made himself unavailable. Anyways, he’s back in the England’s squad.
