Debunking some myths about the 2026 tax reforms: "I heard the government is now monitoring every ₦5,000 transfer and will debit tax automatically." Stop. Relax. There is a lot of misinformation flying around about the 2026 Tax reforms and your bank account. As a lawyer, let’s separate the law from the "WhatsApp broadcast" rumors. 1. The NRS (formerly FIRS) can now automatically pull tax from your bank balance without your permission. REALITY: FALSE. The Nigeria Tax Act 2025 does NOT give the government "remote control" over your funds. Tax collection still follows due process: Assessment, Demand Notice, and Right to Appeal. They can't just "swipe" your money like a Netflix subscription. 2. The 7.5% VAT Confusion: MYTH: There is a new tax on every transfer you send. REALITY: You might see "VAT" on your bank alerts, but it’s NOT on the money you sent. It is 7.5% VAT on the Bank Charge (the ₦10 or ₦26 fee). Example: You send ₦10,000. Bank charges ₦10. VAT is 7.5% of that ₦10 (= ₦0.75). You are NOT paying 7.5% of the ₦10,000. 3. What is ACTUALLY being reported?: So, does the NRS see your transactions? Yes, but only if you hit certain "High Value" triggers. Under the new 2026 guidelines, banks report monthly cumulative transactions of: ₦25 Million+ for Individuals ₦100 Million+ for Corporates If you’re sending "urgent 2k" or paying for lunch, you are not on their radar for this specific reporting. 4. The Tax ID / NIN Rule: The real change? Your NIN is now your Tax ID. Since Jan 1, 2026, you need a validated Tax ID/NIN linked to your account to keep it fully operational. This isn't for "spying", it’s to ensure that people earning billions in profit are actually in the tax net. 5. The "Gift" vs. "Income" Rule: "What if my dad sends me ₦1M for my wedding? Will they tax it?" NO. Personal gifts, family support, and inheritance are NOT "Income." The NRS is interested in Trade, Business, and Professional Earnings. Keep your receipts/narrations clear just in case, but don't panic over personal transfers. 6. The goal of the 2026 reforms is transparency, not "theft." Don't let fear-mongering stop you from using your bank apps. Know the law, keep your records, and ignore the "experts” online who haven't read the Act. Shalom.

So technically, no right of appeal ? Once LPDC delivers its ruling, aggrieved parties can no longer appeal since the issue of where appeal lies has not been resolved ?

At the Supreme Court on Wednesday we were all advised by My Lord the presiding justice to withdraw our pending LPDC appeals. There is currently no recourse for practitioners after LPDC. This needs to be addressed by the profession immediately.

The Supreme Court can order the Registrar to strike the name off the roll, suspend the practitioner, or issue an admonition is found guilty of misconduct by the Court. In conclusion I believe that pursuant to Section 12(7) of the LPA, appeals from the LPDC should go directly

I don’t think that is the true position of the law: Section 233 of the CFRN says: (1) The Supreme Court shall have jurisdiction, to the exclusion of any other court of law in Nigeria, to hear and determine appeals from the Court of Appeal. It doesn’t say “only hear appeals..

Can I speak freely??? They got this type of response because the Appellants are 'average Nigerian Lawyers'. We've had the Supreme Court exercise it's jurisdiction and set aside various directions of the LPDC, sometimes, on extremely technical grounds, in cases involving the Senior Men. Full stop. End of quote.
