The Home Office is not holding back as it seeks to overturn a High Court judge's decision to grant an interim injunction against the use of the Bell Hotel in Epping for asylum seekers It says that the judge's intervention was 'wholly inappropriate' At the heart of Yvette Cooper's case is her statutory duty to prevent asylum seekers from becoming destitute under the human rights act: 1. The Home Office says the judge had 'no regard' for the 'obvious risk' that other local authorities would be incentivised to apply for similar injunctions 2. The Home Secretary's statutory duty to prevent asylum seekers from being made destitute under the human rights act trumps the planning law used as the basis of the injunction. '[The home secretary's] statutory duty is a manifestation of the UK's obligations under Article 3 ECHR, which establishes non-derogable fundamental human rights' 3. The injunction will 'chip away at critical national infrastructure' for housing asylum seekers and was a 'wholly inappropriate vehicle' 4. Criminal wrongdoing by asylum seekers at the hotel is not a 'sufficient reason' to close the accommodation. 'The offences are being properly investigated and are subject to the criminal justice system' 5. The judge paid no heed to the 'obvious practical problems' of relocating 100+ asylum seekers at such short notice 6. The interim injunction could 'act as an impetus for further protests, some of which may be disorderly' around asylum hotels.
