So two things about this:
1. Fish itself, however it's understood, is already a dispensation by the church from traditional fasting law.
2. "Fish" is for all intents and purposes a positive legal category in Roman Church law and only loosely related to a set of biological ones. From my understanding of the history, and I would need to review this, the logic seems to go from fish, to water meat, to that less sumptuous meat that is roughly analogous to the meat of water creatures.
I myself think that Roman fasting law on this should be reformed either to the primitive practice, though this is very rigorous, or to a rational scheme based on observable spiritual effects.
