Congress enacted the birthright citizenship clause to correct the Dred Scott decision.
To give citizenship to freed slaves and their children.
Here are the requirements: born in the United States and subject to its jurisdiction.
Meaning total allegiance.
The 14th Amendment did not cover American Indians.
Congress had to pass separate statutes to give them citizenship.
So ask the Court this question.
If it didn't apply to American Indians, how the hell does it apply to illegal aliens?
It doesn't. Full stop.

@EricHogue0 It's in your original post, immediately above the "alien and foreigner" sentence. It causes me to interpret the intent to be that "aliens and foreigners" in reference only to the ambassadors, foreign ministers, and their families.

If that was true then you'd be able to find a direct quote from him that supports the claim. The reality is jurisdiction means the exact same thing it means everywhere else in the Constitution, which is why foreign families of diplomats were excluded from the 14A.

SCOTUS DISASTER: Under normal circumstances, a 6-3 conservative Supreme Court should rule birthright citizenship unconstitutional in a slam dunk decision.
Unfortunately, when you have RINOs like Roberts, Barrett, and Gorsuch on the court, you never know what's going to happen. It really is unfortunate that we have such a tremendous advantage, and yet can't seem to stop shooting ourselves in the foot!
What is it about Republicans that they just completely are incapable of playing team ball?
We'll have to wait and see.
But with these three on the court, I don't have any great hopes.

It’s so simple, only a complete moron, or TDS leftist, could possibly misunderstand it. A simple understanding of language, punctuation, and sentence structure helps too.
Senator Jacob Howard of Michigan introduced the 14th amendment and said this:
"This amendment which I have offered, is simply declaratory of what I regard as the law of the land already, that every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons."

Mail-in voting makes fraud easy: pair a phony ballot with a fake voter on the rolls, & you’ve manufactured a vote.
I lived it. In 2022, I won on election night, but the press said, “Don’t celebrate, we’re still counting mail-ins.” For two weeks officials kept counting until they got the result they wanted. I took them to court & demanded proof these were real voters, real ballots, & verified signatures.
They couldn’t produce it.
We can’t keep seating people who weren’t legitimately elected. President Trump’s executive order ends this abuse & helps restore trust in our elections.

The left would have a much better argument about birthright citizenship if Section 1 of the Fourteenth Amendment did *not* contain this limiting clause (emphasized below in all caps), which the left chronically ignores:
“All persons born or naturalized in the United States, AND SUBJECT TO THE JURISDICTION THEREOF, are citizens of the United States and of the State wherein they reside.”

Senator Jacob Howard (R-MI) - the guy who introduced the language - made it crystal clear: Not automatic citizenship for children of foreigners/aliens.
‘Subject to the jurisdiction thereof’ wasn’t filler.
They tried to bury this history.

Several Republicans won on Election Day,only to lose a week later. Pres. Trump won by a near landslide. Republicans are unable to accomplish enough to win by landslides.

@MHerronLaw @GuntherEagleman I think the authors of the 14th Amendment are smarter than you give them credit for. If they intended it to only apply to slaves, they would have said so; instead, they made the requirements for birthright citizenship very straightforward.

Trump is right—birthright citizenship is being abused! The 14th Amendment was meant for freed slaves under U.S. jurisdiction, NOT children of illegal immigrants flooding in as “anchor babies.” It incentivizes law-breaking and strains America.
