As jurists, both the appointed Chief Justice Gwaunza and Deputy Chief Justice Garwe are without equal. Chief Justice Gwaunza has long been a trailblazer and has represented the country in international tribunals with distinction. She is a worthy credit to the girl child and an inspiration to many. Deputy Chief Justice Garwe has been a leading jurisprudential thinker and has, in many significant respects, shaped the direction of our law. It is rare that I prepare heads of argument without citing at least one of his authorities. Both are truly deserving of the recognition they have received, and I wish them every success in their new roles.

Parliament s public consultation process that commenced today is a big fraudulent scam that reflects the desperation & immorality of the rag tag team that is pushing Agenda 2030. Through capture coercion & brute force the regime intends to manufacture a false consensus. A fakery that citizens are behind the grotesque cabbage now known as CAB3. But nothing can ever be as further from the truth as this deceit . Zimbabweans in their millions bar a malicious crooked few , corrupted by bandits and gangsters or their insatiable ambition , are vehemently and vigorously opposed to the Cabbage . Today began with abductions . Kingjoy Sibanda , a youth leader from Bulawayo was abducted by 5 men who bundled him into an unmarked white double cab vehicle . Denford Sithole , another youth from Bulawayo was also abducted and bundled in another white double cab vehicle. Tafara Magodora , a student leader from Bindura University was abducted at a bus stop by these strange ubiquitous characters . The systematic use of abductions and forced disappearances is a natural modus of the regime , from Rashiwe Guzha to Itai Dzamara to thousands that disappeared during Gukurahundi . Then came the consultations . They ware nothing but a farcical grand heist . Bulawayo , a City of more than a million people only had two centers , Bulawayo Large City Hall and Nketa . By 6 am the City Hall was packed with persons who the genuine local residents could not identify . Many were later caught on camera heading back to the solitude of their depraved homes after having been used by a desperate cantankerous regime and its billionaire financiers . The meeting started late but in less than two hours it was brought to an abrupt end. By this time only 36 people had spoken . 28 mumbled half understood uniform submissions to the effect that the President must be allowed to “ finish his projects “ Eight firmly rejected the cabbage . The chair of the meeting carefully selected who to pick am .Clenched fists & three fingers were the identity card . Democrats were left stunned . @DavidColtart , the esteemed mayor of Bulawayo and the sheroine Judith Todd couldn’t believe the extend of the bias . His worship , raised his hand to the extend of having cramp . He even stood up in his giant 1,82 m frame but the chair absolutely ignored him. Citizens left fuming in absolute disgust . They had just witnessed the slow evolution of a grand heist . The evolution of a slow unconstitutional , constitutional coup . At Nketa , the mood was different . It was charged & electric . They stood one after the other regurgitating the same tune like an old broken vinyl record . But when Constitutional Defender and @cdfzim member Sheila M… eloquently destroyed the cabbage all hell broke loose . The meeting deteriorated and the hired crowd imploded. Sheila was assaulted and presently requires urgent medical attention . Several other persons were assaulted including Defender Kudzi Maponde. The meeting adjourned after 30 persons had made submissions . Thus in the whole of Bulawayo , Zim s second largest city less than 70 persons were heard in three minute speeches . Parliament has failed to fulfill its constitutional obligation of reasonable and adequate consultation. Chiredzi was yet another disaster . Only ZANU choristers identified by raising 3 fingers were allowed to speak . Former student leader Gilbert Mutebuki was heavily assaulted , with a knife used to slit his thigh . Two of his colleagues are feared abducted with their whereabouts currently unknown. Dema & Chitungwiza were no exceptions. The Chitungwiza Aquatic meeting was an absolute joke . Only 15 citizens spoke . The chair , an “ opposition MP” was embarrassing in his bias. Today proves that ZANU has no shame nor elasticity . The current process is a fraud & a sham But we shall keep on embarrassing same by our attendance . History will Judge them. #NoTo2030

I am painfully having to respond to this for the sake of meaningful dialogue, and I hope we will have that dialogue meaningfully to focus on the real devil in Zimbabwe which is @edmnangagwa It is in the spirit of dialogue that I hope we will navigate this issue @zimbabweyauya and I hope we will soberly reach a logical conclusion quickly so we remain focused to stopping Agenda 2030. We are literally a few hours from official national processes by @ZANUPF_Official to effect the evil CAB3 such that we cannot afford the luxury to focus on fictional psyops on the victimhood of individuals and personalities - the major national issue here is the NATIONAL CONSTITUTION that is at imminent risk of mutilation. It is about the soul of Zimbabwe; democracy, livelihoods - our collective future is under threat and it is only normal for all right thinking citizens to focus on the major issue. I note you have mentioned @BMutebuka but he is the face of coordinated and unwarranted diversionary attacks on @BitiTendai and @freemanchari solely on the basis that they are virtuously coordinating the resistance against ZanuPf’s Agenda 2030 under the auspices of @cdfzim. He is working overdrive to ‘sow the seeds of division’ you are mentioning and we don’t have to meet him to understand that he is a sensational conspiracy theorist whose conduct doesn’t resemble that of a ‘seasoned lawyer and businessman’ as you describe him. His unwarranted anti-CDF obsession which has seen him go into overdrive baseless yet visibly coordinated vitriol against Tendai Biti that makes him write very long politically defamatory loud sounding are pitiful and well credits those he targets for their silence and continued focus on fight ZanuPf to stop CAB3. Tendai Biti had/has nothing to do with Tshabangu, and Mr Mutebuka hasn’t yet come up with a justification on why he obsessively targets him nevertheless. As such, it will only be normal for anyone to see through him that he indeed is on an agenda to create narratives that divert attention on the people’s national fight against CAB3 as led by CDF from the frontline. It’s hard being @nelsonchamisa I have been busy at workshops the last two days and catching up on Twitter … there is a narrative that apparently if anyone raises an opinion especially questioning the intentions of those that supported Tshabangu who are now also purporting to be against the bill … then that person has been sent by Nelson Chamisa …. This is a sophisticated way to SILENCE or gag people from voicing their opinions… wat happened with Tshabangu was extremely heartbreaking … and even at that time some of us said that move was to support Mnangagwa’s illegitimate incumbency beyond the be next election … Y’all need to live with fact that this will live in people’s minds for a long long time !!! Interestingly the same voices instead of helping us fight against Tshabangu they were on an anti Chamisa parade …. So when folk raise it instead of attempting to gag them by saying they have been sent …. Why not apologise so we all move on if truly you have been to Damascus… why is the response to bash Chamisa Maybe some of you have never met the likes of @BMutebuka who is a seasoned lawyer and businessman . We are at a watershed moment. Mnangagwa and his cabal are determined to ramrod the amendments to the constitution illegally. The people who are supposed to lead the resistance from parliament to senate have long abdicated that responsibility. Civic society is decimated and traditional pro-democracy partners hijacked. We are on our own! In the past few months we have been pondering on the way forward. Do we just fold our hands? Do we wait for a messiah? What do we do? In these questions, we also asked ourselves; are our differences bigger than the country? Are our egos more important than our constitution? Both times, the answer was an emphatic NO! So, we resolved to start laying the foundation for a resistance movement solely focused on the protection and defense of the constitution of Zimbabwe - hence; CONSTITUTION DEFENDERS' FORUM. We are growing a FIG TREE. Those who want SHADE will find it. Those who want ROOTS will find them. Those looking for BARKS will find them. Those looking for FRUITS will harvest them. But, it is also a tree that is growing in a desert. The terrain is harsh. We are going to need some watering, some manure, some fences and tending. This is where everyone of us has to play a part. You may think you are too small to make an impact but your presence and input increases the resonance, the more we push together the more our amplitude rises and at some point the force become unbearable. The people on the ground in Zimbabwe will be embarking on different forays to organize and galvanize the people. This comes at great risk to them but they are determined. Our responsibility especially in the Diaspora is to make sure that we provide solidarity, reclaim the narrative and provide a voice that is bigger than that of the system. We will be opening channels of engagement, feedback and participation for all as we go forward. If there is something you feel you are good at, just say the word and we will plug you. We need to move forward together. If what we are building is not a good fit for you but you still feel this Constitution needs to be defended, we urge you to not waste time and effort in disappointment, instead ORGANIZE and push from your end. ONE STRUGGLE, MULTIPLE FRONTS!!!!!

The Constitution of Zimbabwe, ratified in 2013 following 4,821 exhaustive public outreach meetings across 1,950 wards, enshrines the profound sacrifices and aspirations of Zimbabweans, rooted in the pre-1980 liberation struggle for independence and the post-1980 pursuit of authentic democracy. This COPAC-led process, spanning 105 days, united farmers, students, mothers, workers, and youth in a wave of hope and solidarity, forging a robust framework for rights protection. Drawing from the indomitable spirit of both the pre-independence liberation and post-independence democratic efforts, it culminated in a triumphant referendum, where everyday Zimbabweans from all walks of life delivered a resounding 95% approval. In a profound betrayal, ZANU-PF’s Amendment (No. 3) Bill, H.B. 1, 2026, advances through a mere 64 hearings scheduled from March 30 to April 2, 2026 - averaging fewer than seven per province over four days - constituting a calculated procedural coup that silences millions of voices. The bill audaciously extends terms of office, transfers presidential elections to parliamentary selection, postpones polls until 2030, reassigns voter oversight, overhauls the judiciary, politicizes traditional leadership, and abolishes the Zimbabwe Gender Commission, thereby entrenching state capture and authoritarian control while violating our cherished democratic achievements. This disparity reveals catastrophic democratic decay and regression, eroding pluralism, desecrating Section 67’s fundamental rights to political participation, and setting Zimbabwe’s democracy back by decades. All Zimbabweans must actively confront this malaise, which threatens to consolidate unaccountable power and undermine the 2013 Constitution’s participatory principles. The Constitutional Defenders Forum @cdfzim urges individuals and organizations to engage fully in the public hearings from March 30 to April 2, 2026, by attending provincial sessions, submitting written representations to Parliament (via bills@parlzim.gov.zw or designated deposit boxes), and opposing provisions that weaken direct democracy and institutional independence. We must challenge this backsliding through lawful avenues, including petitions, civil society campaigns, and advocacy for a national referendum, ensuring amendments align with the popular will rather than elite agendas.
