BREAKING: SWEET JUSTICE! The Tennessee man who was jailed for over a MONTH for posting harmless Facebook memes about Charlie Kirk receives an $835,000 settlement.
And it gets so much better...
“I am pleased my First Amendment rights have been vindicated. The people’s freedom to participate in civil discourse is crucial to a healthy democracy. I am looking forward to moving on and spending time with my family," said Larry Bushart, the 61-year-old retired police officer who was held for 37 days behind bars.
He was arrested in September after refusing (as is his right as a red-blooded American) to delete memes mocking the assassination of far-right provocateur Charlie Kirk. Whatever one thinks of such humor, it's undeniably protected by the Constitution.
Bushart was the victim of weaponized conservative backlash and local authorities used the most absurd rationale to imprison him.
One of the memes read “This seems relevant today...” and quoted Trump saying that "We have to get over it" after a school shooting in 2024. The implication was clear: if Republicans are going to tell us to "get over" mass shootings without changing guns laws, then they'll just have to "get over" Kirk's death.
Rather than interpret the meme in good faith as something that he merely found offensive, Perry County Sheriff Nick Weems claimed that the "hate memes" scared local residents who were afraid that Bushart was threatening to carry out a shooting. Clearly, he was doing nothing of the sort.
The profound irony is that Kirk himself purported to be a committed free speech activist. While "defending his memory" these conservatives have desecrated his principles.
During his lawless imprisonment, Bushart lost the job that he had acquired post-retirement, missed his wedding anniversary, and was unable to be present for his granddaughter's birth. His bail was set at $2 million but he was eventually released after the absurd incident drew nationwide outrage.
Bushart sued the county, the sheriff, and the investigator who cobbled together the sham arrest warrant. He has now been fully vindicated.
“It’s in times of turmoil and heightened tensions that our national commitment to free speech is tested the most,” said attorney Cary Davis of Foundation for Individual Rights and Expression, which assisted in the lawsuit. “When government officials fail that test, the Constitution exists to hold them accountable. Our hope is that Larry’s settlement sends a message to law enforcement across the country: Respect the First Amendment today, or be prepared to pay the price tomorrow.”
