New Year, new thread. I'm almost surely not going to read as many books as I did in 2018, both because I'll have two semesters of law school this year instead of one, and because, God willing, I'll have an actual job this summer. But whatever I read, I'll post here.

@ASFleischman Likewise the best trial attys are those whose clients just always happen to be on the right side of the facts and law. I don’t think jurors are disingenuous in praising losing attys, they just see and admire the strings being pulled.

@ASFleischman Writing works similarly. The best persuasive writing doesn’t seem like good writing. It just seems like someone who is explaining what is very obviously the stronger side of an argument.

The worst lawyers are the ones who tell me that jurors love them. This is rarely reflected in the verdicts. It's a way to deflect from their not investigating the case or thinking about jury charges.

@ASFleischman My most deeply held belief is that everyone thinks they are good at litigation in the same way that everyone thinks they are a good driver. But litigation is a skill like any other. It has to be learned.

Man arrested in Kentucky for riding on a horse while drunk, a claimed violation of Ky St. 189.520, operating a non-motor vehicle while intoxicated. But is a horse a "vehicle"? No Kentucky cases on this, but police report on left, code's definition of a "vehicle" on right.

@adam_shniderman I read the highlighted paragraph as adopting that fallacy. I.e. comparing the probability “of a DNA mixture that includes the target’s DNA”. Instead (1) should be “the probability of this DNA mixture, given that it includes DNA from the target”. The same fallacy…

@kane Where does it say anything about cases being dismissed? I only see the article saying that the 250 cases were instead assigned to private counsel rather than the public defender.

@Greg651 I agree with you that the 40 min is niggling. I think if I were a judge I would probably just let it slide. But I would *def* not want defendants who aren’t hurting anyone getting arrested for being a couple minutes late getting home from work 5-6 times.

@Greg651 They’ll usually wait and collect a few such violations (but could certainly be less than 40 min total) before coming and arresting without any warning whatsoever.

@OrinKerr What's notable about the Kavanaugh concurrence, to me, is that he seems to be abandoning this line of thinking, and saying that profiling as fine, as long as you're profiling on characteristics that are at least arguably meaningful, on average. No further 4A restriction.

@OrinKerr I have never thought that the basis for these rulings was that these facts have absolutely no evidentiary value (even if that's what the courts say). It's bc we don't want to give police license for seizing ppl based on race, ethnicity, being in a particular public place, etc
