@kimmoorepoet @janerace As Jane said, gaining the publishers permission is the best option, which a poet who says yes may also need to have done. IME if the work you produce is not a risk to the reputation of anyone cited then it is usually seen as free marketing - just cover your back!

@kimmoorepoet @janerace Okay, so that’s what I call a Demi Cento. As you’re using mixed fragments, if those you don’t have clearance for are <10% of the original & are fully referenced then there’s little to argue with. Code or foot/endnote each fragment clearly & keep evidence of attempts to contact.

@kimmoorepoet Technically, freedom of expression is supposed to cancel out copyright if the source material is fully cited anyway, but IME it can still be tricksy. I work with existing material a lot and it is a legal minefield - but I’ve only once had a big problem, (so far!).

@kimmoorepoet I’ve used cento in my PhD and for Ethics I had to get written permission from the copyight holder as well as do the obvious referencing of every single detail (formatting, punctuation, and words). Quotation is not sufficient because one is actively changing the composition.

@kimmoorepoet For parody & pastiche, 10% of the original is a legal standard. In poetry, that only applies to the words… head/desk… but it does cover brief cento usage.
