It can thus be recorded or reported as a “hate incident” or even a “hate crime.” However, because IHRA is not legally binding, law enforcement still has to decide whether there was actual hostility toward Jews. If they conclude it was political speech about a state—not about Jews—they won’t prosecute it as a hate crime. So what do you get? A “hate crime” on paper that is not prosecuted as a hate crime in law. That inflates the number of recorded antisemitic hate incidents while not increasing prosecutions—making it look like antisemitic crimes are being ignored or under-prosecuted compared to other groups. It is important to know whether hate crimes against Jews are being prosecuted.
