That was the vote margin in the decision of the United States Court of Appeals for the Ninth Circuit.
And at the center of the ruling was a single incident: a Korean spa business in Washington state refusing transgender women as customers.
The decision issued in May 2025 said the state’s anti discrimination law could be applied, rejecting the business’s First Amendment defense (freedom of religion, expression, and association).
⚖️ THE REAL MECHANICS BEHIND THE CASE
The incident began in 2020.
In Washington, a transgender woman filed a complaint saying she was denied entry to Olympus Spa, a women only nude spa.
Following the complaint, the state’s anti discrimination law came into effect:
• Washington Law Against Discrimination (WLAD)
• It prohibits discrimination based on “gender identity” in places of public accommodation.
The court’s interpretation was clear:
If a business serves the public, it cannot refuse a customer because of gender identity.
The spa owners presented the following defense:
• The spa area requires full nudity
• Female customers may feel uncomfortable due to anatomical differences
• Therefore we only accept “biological women”
However, the court rejected this argument.
📊 THE LEGAL LOGIC OF THE DECISION
The court ruled against the business based on three main points:
1️⃣ The spa is a public accommodation
→ not a private club or religious institution
2️⃣ Massage services are not protected as free speech
→ they are considered a commercial service
3️⃣ The anti discrimination law is a general and neutral law
→ it does not provide a special exemption for religious beliefs
Therefore the court concluded:
“The spa’s First Amendment rights were not violated.”
🔥 WHY IS THERE SO MUCH NOISE ON X?
Because the viral part of the story is not the decision.
It is a dissent.
A judge appointed during the Trump era strongly opposed the ruling and used unusually harsh language in the dissenting opinion.
That wording even sparked controversy within the court and was criticized by 27 judges.
So the viral tweet actually reflects the language dispute in the dissent, not the core court decision.
🧠 THE PERCEPTION MANAGEMENT LAYER
On social media the narrative is usually framed like this:
“The court forced women’s spas to allow men inside.”
But the legal framework is different.
The court says transgender women cannot be excluded from public services.
