Stigler's Birmingham gun trade shows why the knot of hands is easily broken and not easily retied. Specialists only exist if the market sustains them. Move the people without moving the conditions and the project disappears. henryruler.substack.com/p/the-knot-bre…

Stratas JA names which line governs and treats the inconsistent decision as an outlier rather than equal authority. The problem is that without the SCC naming the governing principle itself, every lower court faces the same choice Stratas made here.
Mark P. Mancini@MarkPMancini

Considering the Supreme Court's inconsistency in public law, Stratas JA picks a lane. The recent line of SCC cases emphasizing the text of the law should be followed, while a recent SCC case should be seen as a methodological outlier. @DoubleAspect @MichaelPlaxton 2026 FCA 88

3/3 Wilson aims for the protection of natural rights through crime prevention. The question is, Can a rights-based framework generate the civic culture that gives law its moral authority?

2/3 Aquinas aims for the restoration of the order of justice. The question is, Does the state have the civic formation required to carry out meaningful restorative efforts?

1/3 Murray's taxonomy is useful. Aquinas as restorative retributivist. Wilson as negative retributivist. I would ask what each withholds in order to maintain their position.
Lawrence Solum@lsolum

Brian Murray (Seton Hall): Wilson and Aquinas on crime and punishment are closer than their historical gulf suggests — Wilson's natural-rights framing is evidence the Founders were not exclusively positivist. 75 Cath. U. L. Rev. 421. legaltheoryblog.com/?p=111633

3/3 Better to ground flexibility in transparent evidence and incentives, not fluent rhetoric that excuses whatever the moment demands.

2/3 All priors are provisional by design. This normalizes endless deference to unfolding constraints and expert discretion, turning leadership into perpetual course-correction without anchors.

1/3 Technocratic governance is a perpetual license for serial adjustment. The "values" provide the normative vocabulary and the appearance of principle. The "pragmatism" supplies the means of egress.

2/2 But this describes one threshold of access. There is another: what a text does as an act of address from a specific position. Philology does not produce it. More of it does not either.

1/2 The range of what must be readable is built into why anyone learns it. Dialect, idiom, transmission. It's the threshold of access to what a text says. "Knowing Greek" cannot mean only getting by in it.
Nadya Williams@NadyaWilliams81

Classics graduate training may seem odd to outsiders: you just read loads of Greek and Latin for years! Someone asked a classicist friend once: "why are classicists so obsessed with philology?" It's difficult to explain just what exactly classicists do and why they're necessary.

3/3 The pattern is collaborative and sequential. Court signals, legislature responds. Both branches stay in the conversation. Pre-emptive use interrupts this.

2/3 Her insight is that strike-down is rarely the guillotine of theory. Courts hold back and leave legislative room. Canada exemplifies this.

The Charter bet on citizens who treated principle as binding. That bet has a face: Eugene Forsey. Absorbed the constitution by proximity as a child. Stood against Prime Ministers when needed. Showed what real civic formation once looked like. henryruler.substack.com/p/what-the-for…

When two analysts committed to the same cause reach loggerheads, a lull is often more productive than continued exchange.

I don't mind @DoubleAspect abusing me as a populist clown; but if he is going to write at length about my lack of virtue, the polite thing would have been to let me know that he's written about me. As things stand, I can only say that his lack of manners reflects badly on him.
