The 1949 case of Avelino v Cuenco gives the new 12-member Senate majority legal basis for their actions today. If Cayetano's group disagrees, they can bring the matter before the SC. It will be interesting to see if the SC considers it as a political question or not.

Illegal cause he was not there… he thought that by making himself unavailable, the minority of 11 cannot muster a quorum… he forgot the 1949 decision of Avelino v Cuenco where the SC rules that “While the Philippine Senate consists of 24 members, several justices reasoned that because Senator Tomas Confesor was absent and in the United States, the actual reachable membership was 23; therefore, an absolute majority of 12 senators constituted a valid quorum to do business.” The same was concurred in by Justice Feria where he said “explicitly argued that the base number for a majority must be limited to "actual members who are not incapacitated to discharge their duties by reason of death, incapacity, or absence from the jurisdiction of the house or for other causes which make attendance of the member concerned impossible, even through coercive process"
