The All India Central Council of Trade Unions @AICCTUhq observed an all India protest day on 17 April in support of the workers' protests across North India. The workers demands for a living wage, workplace safety and rights, and an end to exploitative working conditions, are based on the constitutional promises of socio-economic justice, economic equality, and a dignified life for all. The labour codes brought in by the BJP government run contrary to these constitutional promises.

The ubiquitous image from West Bengal this election. People carrying documents in little bags, moving from one office to the other wanting their names back in. What is driving people is not just the prospect of missing a vote. When the Supreme Court of India observed that those left out can vote the next time, it reduced the issue to an electoral inconvenience. But on the ground, it is being experienced very differently. For many, the voter list is not just about participation in an election. To find your name missing, without explanation, while others in your family remain, is to be pushed into a space of doubt. Devil is in the details!! - A mischief in the #Constitution (One Hundred Thirty First) Amendment Bill, in the name of #womenreservation, is to empower #Parliament to decide, from now on, which Census will be used for delimitation and how often delimitation will happen! At present, Articles 55, 81 and 170 provide for the 'population' to be determined for the purpose of election of President, composition of #LokSabha and composition of State Assemblies respectively. Presently, this 'population' refers to population on the basis of Census of 1971 (to determine number of seats) and 2001 census (to determine boundaries of those seats). This was frozen in the #Constitution itself, till Census after 2026 is conducted. Originally, as provided in Articles 82 and 170, number of seats in #LokSabha and State Assemblies were supposed to be readjusted after each Census i.e. once every 10 years. But this was frozen, as is popularly known, due to difference in population growth rates across states. Now, what is being proposed is as follows: 1. Mandate to use population numbers from Census of 1971 and 2001, till after Census of 2026 has been conducted, will be deleted. 2. It will no longer be explicitly mentioned in the Constitution that every time a Census happens, it will be followed by readjustment of seats i.e. delimitation will be delinked from census and government can choose when to conduct delimitation. 3. Parliament can bring an ordinary law to determine which Census will be used for delimitation purposes as and when it happens. 4. Women reservation will be implemented on the basis of proposed delimitation only, using whatever Census data #Parliament decides to use. Now, the #Constitution Amendment Bill, in the text of the Bill, doesn't say that the Census of 2011 will be used for the proposed delimitation as that will now be determined by #Parliament later, by bringing another Bill. But the Statement of Objects and Reasons of the Bill says that 'latest published census' will be used, which is the 2011 Census. The Delimitation Bill (an ordinary bill) also refers to 'latest census figures'. So, for the 2029 #LokSabha elections, the 2011 Census will be used to determine how the 850 seats, including seats reserved for women, Scheduled Castes and Scheduled Tribes will be distributed across states. Who is likely to gain and who will lose? But whether after Census 2026, which is also supposed to include Caste Census, another delimitation will happen, we don't know. It will no longer be mandatory to conduct delimitation after every Census. Even if delimitation happens, #Parliament can make law to say that 2011 Census will be used. As for increase in number of seats in Legislative Assemblies, that is to be determined after delimitation is conducted and what the total number will increase to is now known yet.

The BJP through this Bill has institutionalised two major Brahmanical forms of marginalisation and stigmatisation of transgender persons -- i) by eliminating the statutory foundation for the right to gender self-determination on the "basis of any acquirable characteristics or personal choice or claimed self-perceived identity", the BJP is implying that transgender identities cannot be acquired and these acquired, personal identities as abnormal and unnatural. In simpler words, the BJP is saying that trans men, many trans women, and genderqueer people suffer from mental disease and disorder, and/or are coerced into acquiring such identities. ii) it has revived and legislatively endorsed pernicious myths that cast trans people as evil coercers, which criminalises the transgender persons. Traditional kinship and community support systems such as the guru-chela networks, deras, and gharanas that provide shelter, mentorship, and livelihood could now be construed as “compelling” individuals into a transgender identity. Parents affirming their child’s gender identity, social workers providing counselling, non-governmental organisations offering housing and livelihood support, and medical professionals delivering gender-affirming care all face potential criminal liability. The message is simple -- socially and legally criminalise the transgenders, segregate and enforce further marginalisation of the community within the social structure. The “accepted” identities will be processed as subjects, robbed of their privacy and dignity, their identity left at the discretion of the “Authority”. This draconian and unconstitutional Bill nullifies the very limited progress made in transgender rights, welfare, and reverse decades of advocacy for recognition, dignity, self-respect, inclusion, justice and empowerment for the transgender persons. This Bill advances systematic exclusion, trauma and violence, both physical and symbolic, of the transgender persons. It disproportionately harms transgender individuals from marginalised caste backgrounds. Dalit, Adivasi and Muslim trans and genderqueer persons, who face deep economic precarity and social exclusion, already struggle with systemic barriers to resources, safety, livelihood and dignity, and are now at heightened risk of losing even the limited legal protections and social supports they had.
