Deviation is something you guys should understand.
Where a person departs from a common purpose to do something that does not aid or affect the others, only that person will be liable — though it can still appear on the same charge sheet, just under different counts.
Take the Mitch Rapp scenario (if I remember correctly): after the robbery was completed, he fought with Robb and shot him. That is deviation. He moved away from the common purpose of robbery to commit a personal act.
This is different from a situation where someone shoots a police officer to facilitate escape — that still falls within the common purpose.

This particular one, the friend that recognized him could have seen all of them and that was a risk. So him shooting his school friend is to protect his people. It’s still to aid others in the common purpose. All of them will be charged.

@Nessadivaaa This is very conflicting and it is strictly for FHC if you are not careful you might think it applies to SHC. To be on the safe side, I am honestly of the opinion that one should include the judicial division besides its only one line.

This isn’t correct oooo, our lecturer said we should add it. Please be careful with positions that might make students lose marks. Verify before posting anything about Law school topics or exams.

Also because the it was his personal enemy not of the other members, basically he wasn't part of or a hindrance to their transaction.

My favorite topic in law school was charges, mehn—across all courses.
Which year of past questions on charges did I not draft? 2010–2025. I loved that topic and drafted it a lot because it was very tricky.
There was a snap test we did in Lagos. Almost everyone chose manslaughter, but I stood my ground on murder—and I was correct.
In charges, you should know the difference between robbery, armed robbery, and stealing.
Also know when it is murder or manslaughter. Know the definitions.
Also know who a principal offender is—Sections 7 & 8 of the Criminal Code.
Also know that you don’t charge with the definition section—you charge with the punishment section.
Also know when a transaction has started and when they have ended it and gone their separate ways.
Know that two people cannot be charged for rape on the same count—it’s always different counts.
You can’t charge a dead man or someone who has not been arrested.
You should know how to charge outside jurisdiction.
Know the principle behind conspiracy.
Know when to draft another charge sheet.
A lot of things to learn in charges, mehn.
