THE DEMOCRATIC WAY OUT NOW
It is a matter of happiness that the Gen Z youth movement in Nepal is gradually heading towards a peaceful resolution! Heartfelt congratulations and best wishes!
However, just as our proverb says “It is harder to deliver the offering to the priest than to perform the funeral rite itself,” the challenges are still ahead or rather, they have only just begun. Therefore, it is essential to move forward with prudence and patience.
Contrary to what some self-proclaimed intellectuals are claiming, the country has not reached a state of being “constitutionless” or “stateless,” nor should it ever be pushed into such a void. Even if the government resigns, the fundamental pillars of democracy the Constitution, the Parliament, the Head of State (President/Vice-President), and the permanent organs of the State remain intact. The leaders of a new Nepal, especially Gen Z, must not fail to move forward by standing firmly on those foundations. Otherwise, in trying to pick up something from the ground, one risks losing what is already in one’s pocket.
History shows that the law of progress is to preserve the old while building the new. At this critical stage the most important thing to protect is the sovereignty, autonomy, and territorial integrity of the nation, as well as the sovereign power and state authority vested in the people. These are declared unamendable under Article 274(1) of the Constitution, promulgated through the Constituent Assembly elected on the strength of historic movements. (Please refer to the important constitutional provisions of Constitution of Nepal.)
The most urgent matter right now is to address the demands raised by the movement and to form an interim government with the recommendation and participation of the movement’s representatives, in order to swiftly hold fresh general elections. This must be done within the framework of the existing Constitution; otherwise, grave misfortune may follow.
First, meaningful dialogue and negotiations must take place between the official representatives of the movement and the President, who at present is the highest representative and guardian of the State. Other individuals or institutions may facilitate the process, but under these extraordinary circumstances, this responsibility must be carried out directly by the President.
Second, a question may arise: since the current Constitution has no provisions for either holding immediate general elections or forming a government led by someone outside Parliament, what should be done? The answer is that since the Parliament is still alive, it can and must be convened even for a single day to make the necessary constitutional arrangements. Therefore, the emerging new parties must not, in a rush of emotion, resign from Parliament, but rather remain within it to play their crucial role. Likewise, all parties represented in Parliament must act responsibly and cooperatively during this time of national crisis.
Let the serious attention of all concerned be drawn to this. Otherwise, the nation may plunge into a terrifying dark tunnel, a Black Hole.
