When the Birmingham Six were trying to overturn their convictions they were thwarted again and again over 16 years by a stubborn and dismissive establishment. The attitude was epitomised in the iconic judgment by Lord Denning. He refused to countenance the idea of them being innocent because that would damage the integrity of the system and in his opinion the system needed to be protected at all costs. In his judgment Denning said: If the six men win, it will mean that the police were guilty of perjury, that they were guilty of violence and threats, that the confessions were involuntary and were improperly admitted in evidence and that the convictions were erroneous. That would mean the Home Secretary would either have to recommend they be pardoned or he would have to remit the case to the Court of Appeal. This is such an appalling vista that every sensible person in the land would say: It cannot be right these actions should go any further. This justice system has been a fraud for years !!!!!

@James_Treadwell Surely you must know that there are many tenuous convictions reached on very thin evidence. Would be interested to hear your opinion on my grandson’s case

@jengbaJones X not a great format, but common law doctrines can be almost impossible to remove, especially with current common law framing of murder. JE has attracted much ire, some fair. I'd reform the law on murder in light of Law Comission recommendations seeking to reduce much use of JE.

I have been going into #prisons since the 1990s of all types, from high security to open prisons, not only in the UK, but in the US, Australia, New Zealand. I can count on one hand the number of prisoners I've met that I think under current arrangements shouldn't be in prison.

@Jliffe @Juvenis I reckon these judges’ are like car show men. On commission for every kid they send to prison for life. Probably about 5 grand a pop
