Zimbabwean man loses High Court bid to overturn Home Affairs ban after court confirms permanent residence permit obtained for R12 000 was fraudulent and invalid The Western Cape High Court has dismissed a Zimbabwean man’s application for an extension of the 180-day period to review Home Affairs’ decision declaring him a prohibited person over a fraudulent permanent residence permit. The case involved 40-year-old Fidel Isheanesu Mugunzva, who challenged the department’s findings and restrictions placed on him. According to court records, Mugunzva first entered South Africa in 2011 on a visitor’s visa that expired in October and later November that year. In 2012 he obtained a permanent residence permit through an immigration agent named Wendy after paying R12 000, later using it for travel, employment, and banking. In 2020 the Department of Home Affairs informed him that the permit did not exist and was fraudulent, declaring him a prohibited person. Mugunzva returned to Zimbabwe in 2022 and told the court he was too poor to pursue legal review, although judges questioned his financial claims and supporting documents. Despite finding that Mugunzva may have had reasonable prospects of success and that Home Affairs did not properly allow representations or fully investigate whether he was a victim of fraud, the court ruled that his excessive delay in launching the review application outweighed those factors and dismissed the case accordingly.
